COMMISSION MEETING – June 27, 2005
A regular meeting of the Cullman County Commission was held on Monday, June 27, 2005, at 10:00 a.m., in the County Commission Office Conference Room. Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough. Chairman Kitchens called the meeting to order and welcomed the visitors. Attorney, Dan Willingham gave the invocation and Chairman Kitchens led the pledge of allegiance.
APPROVE MINUTES OF
JUNE 13, 2005 MEETING
Commissioner Yarbrough made the motion to approve minutes of the June 13, 2005 meeting as recorded. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
APPROVE
APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE, ETC.
Commissioner Yarbrough made the motion to approve appropriations, expenditures, requisitions, travel expense, etc. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
APPROVE ALL
JOURNAL ENTRIES TO BE POSTED
Commissioner Yarbrough made the motion to approve all journal entries to be posted. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
AUTHORIZE CHAIRMAN TO SIGN COOPERATIVE AGREEMENT WITH CULLMAN COUNTY JUVENITLE CENTER AND CULLMAN REGIONAL MEDICAL CENTER
Tonya Sears, Director of the Juvenile Dentition Center stated a Cooperative Agreement between Cullman County and Cullman Regional Medical Center is needed, stating that we will take juveniles to them and CRMC will provide services in case of emergency. This is a requirement of the Department of Youth Services for us to obtain our licenses.
Commissioner Williams made the motion to authorize the Chairman to sign a Cooperative Agreement. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
AUTHORIZE CHAIRMAN
TO SIGN CONTRACT FOR SERVICES – CULLMAN COUNTY COMMISSION AND CULLMAN AREA
CHAMBER OF COMMERCE
Commissioner Yarbrough made the motion to authorize the Chairman to sign contract for services between the Cullman County Commission and Cullman Area Chamber of Commerce. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
SURPLUS 2000 MITSUBISHI – SANITATION DEPARTMENT
Gary Teichmiller, County Administrator stated this vehicle was involved in an accident on 4/26/05. The insurance claim has been settled and needs to be removed from inventory. VIN # JW6CCG1G2YL006997
Commissioner Williams made the motion to surplus the 2000 Mitsubishi. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

Commissioner Williams made the motion to surplus vehicles from CARTS. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
RESOLUTION NO.
2005-41 DESIGNATE SOURCE OF FUNDS FOR CARTS
Randall Shedd, Director of Commission on Aging stated this resolution requires the Commission to designate funds for the operations of the CARTS program. This budget funds reflects a 3% increase from the county.
Commissioner Yarbrough made the motion to designate funds for CARTS operations. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

2005-42 AUTHORIZING CARTS OPERATIONS
Mr. Shedd stated this authorizes the Chairman to sign grant applications for Federal Funds and Operations of CARTS.
Commissioner Yarbrough made the motion to authorize carts operations. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
CONSIDER APPROVAL
OF CARTS BUDGET
Mr. Shedd stated this year’s budget is very similar to last year’s budget, it does reflect a 3% increase from last year’s budget. The budget includes Federal Funds, Contract Services and etc.
Commissioner Williams made the motion to approve the CARTS Budget. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
CULLMAN COUNTY
WATER DEPARTMNET – DAVID BUSSMAN
Mr. David Bussman, Director of the Cullman County Water Department announced due to the increase in water rates (27.14%) from the City of Cullman, county residents can expect another water rate increase (10-15%) the first part of October.
CONSIDER AWARDING
BID NO. 811 MUD CREEK MOWING
Mr. Widner stated only one bid was received from Hammrick Septic Tank for $10,000.00.
Commissioner Williams made the motion to award Bid No. 811 to Hammrick septic Tank. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
CONSIDER APPROVAL FOR CLEAN-UP OF OLD JAIL
Gary Teichmiller stated that Serve Pro was ask to look at the Jail and give an estimate to clean, sanitize and etc. The estimate was for $11,002.32. Mr. Teichmiller stated clean up would be able to state as soon as they are notified.
Chairman announced that the Jail would be used for departments to store records and etc.
Commissioner Yarbrough made the motion to let Serve Pro do the clean up of the Jail. Commissioner Williams seconded, and upon a voice vote, motion carried unanimously.
NRCS – CHECK FOR CREEK CLEAN UP
A representative from NRCS presented a check in the amount of $149,000.00 from the Emergency Water Shed Program for the clean up from the 2002 tornado. We appreciate the cooperation from the Commission, Road Department and the Assistant Engineer Fred Penn.
AUTHORIZE CHAIRMAN
TO PURCHASE PROPERTY LOCATED AT 614 2ND AVE. S.W.
Chairman Kitchens stated this is the Bledsoe property owned by Dr. Nielsen. Purchase price of this property is $300,000.00. I believe this will be beneficial to the county to go ahead and purchase the property at this time.
Commissioner Williams made the motion to authorize the Chairman to purchase the Bledsoe property. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
HEALTH CARE
AUTHORITY
Chairman Kitchens read a letter to the Health Care Authority expressing the Commission’s commitment to stand with the Boards decision to pursue negotiations to buy Baptist Health System’s 50 percent ownership of Cullman Regional Medical Center.
Mr. Steve Glasscock, Chairman of the Healthcare Authority expressed appreciation from the Healthcare Board for the support of the Commission.
AUTHORIZE REVENUE COMMISSIONER TO SIGN CONTRACT
Mr. Willingham stated the Revenue Commissioner has been negotiating with the Cullman Electric Coop in sharing the expense of Ariel photographs that both departments uses and will beneficial to both departments. The Revenue Commissioner needs authorization from the Commission to sign a five (5) year contract.
Commissioner Williams made the motion to authorize the Revenue Commissioner sign the contract. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
LETTER TO THE
EDITOR
Mr. Willingham addressed a letter to the editor in the Cullman Times with allegations of criminal active and violations of ethic statues against county employees. To my knowledge the Commission has not received any allegations in this regard. Someone has written a letter to the editor that puts a real responsibility on the Commission if you have such information. Anytime someone has this type of information they should notify the proper authorities. The Commission is unaware of County Employees receiving benefits of this kind from the county. When you read something like this in the paper its extreme allegations and very serious.
PUBLIC COMMENTS
Phyllis Little, EMA Director stated her office has a computer that needs to be replaced due to water damage that occurred over the weekend on the first floor of the POB Building.

partnership they have with the County Commission.
