COMMISSION MEETING – July 25, 2005

 

 

A regular meeting of the Cullman County Commission was held on Monday, July 25, 2005, at 10:00 a.m., in the County Commission Office Conference Room. Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough. Chairman Kitchens called the meeting to order and welcomed the visitors. Attorney, Dan Willingham gave the invocation and Chairman Kitchens led the pledge of allegiance.

 

APPROVE MINUTES OF JULY 11, 2005 MEETING

 

Commissioner Yarbrough made the motion to approve minutes of the July 11, 2005 meeting as recorded. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

APPROVE APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE, ETC.

 

Commissioner Yarbrough made the motion to approve appropriations, expenditures, requisitions, travel expense, etc. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

APPROVE ALL JOURNAL ENTRIES TO BE POSTED

 

Commissioner Yarbrough made the motion to approve all journal entries to be posted. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

CONSIDER ADOPTING ALCOHOL AND DRUG ABUSE POLICY

 

County Attorney Dan Willingham stated the handbook states the county will provide a drug policy. You may have had something light with a few paragraphs, this is a solid statement of the county’s drug policy.

Commissioner Williams made the motion to adopt the Alcohol and Drug Abuse Policy. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

CONSIDER ADOPTING GUIDELINES FOR ACCEPTANCE OF ROADS INTO COUNTY MAINTENANCE SYSTEM

 

County Attorney Dan Willingham stated the County has a lot of public roads and some may be private roads with several houses along these roads.  The county can’t maintain these roads unless they are taken into the county’s maintenance system. The county has put together a set of guidelines to get these roads up to a standard to take into the county’s maintenance system. This is not a way for developers to avoid the statues for subdivisions. Alabama has laws for subdivisions as well as the county. Developers must be in compliance with those standards.

Commissioner Williams made the motion to adopt guidelines for accepting roads into the county maintenance system. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

CONSIDER APPROVING TAX ABATEMENT FOR WRAY BROTHERS

 

Commissioner Williams made the motion to approve the Tax Abatement for Wray Brothers. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

CONSIDER AWARDING BID NO. 815 EMILSIFIED ASPHALT

 

County Engineer Philip Widner stated four (4) bids were received. I recommend awarding the bid to Ergon who was the low bidder.

Commissioner Yarbrough made the motion to award Bid No. 815 to Ergon. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

CONSIDER AWARDING BID NO. 816 USED RAILCAR TANKERS

 

Mr. Widner stated one (1) bid was received. It’s my recommendation to award the bid to Diversified Railroad Cars.

Commissioner Yarbrough made the motion to award Bid No. 816 to Diversified Railroad Cars. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

SURPLUS ONE SAVIN 9400D COPIER – JUVENILE PROBATION

 

Commissioner Williams made the motion to surplus the Savin 9400D Copier. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

SURPLUS VARIOUS OFFICE EQUIPMENT – JUVENILE PROBATION

 

Commission Yarbrough made the motion to surplus office equipment. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

CONSIDER ADOPTING CITY ORDINANCE NO. 2005-19

 

Mr. Willingham, County Attorney stated the City of Cullman has passed a City Ordinance prohibiting smoking in the work places, which prohibits smoking in all enclosed facilities. Also, prohibits smoking within 15 feet of an entrance way.

Commissioner Williams made the motion to adopt City Ordinance 2005-19. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

 

 

E-911 BOARD APPOINTMENT – COMMISSIONER WILLIAMS

 

Commissioner Williams made the motion to reappoint Jack Hopper to the E911 Board. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

E911 BOARD APPOINTMENT – CHAIRMAN KITCHENS

 

Chairman Kitchens made the motion to reappoint Gordon Dunagan to the E911 Board. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

CARTS

 

Commissioner Yarbrough made the motion to table this item until it has been discussed with all parties involved. Commissioner Williams seconded, and Chairman Kitchens stated this item will be tables.

 

CITY VS. COUNTY BLOOD DRIVE

 

Cherrie Haney with the Economic Development announced the City vs. County Blood Drive will be Friday, July 29, 2005 from 8:00 to 5:00.

 

TRAFFIC SIGNALS AT AL 69 AND COUNTY ROAD 222

 

Mr. Willingham stated he had a resolution pertaining to ALDOT installing three (3) traffic lights on Al 69 in Good Hope. ALDOT will cover half of the installation and Commissioner Yarbrough has obtained some donations from individuals. This resolution is for the County to a pay $5,000.00 toward a traffic control light installation at Al 69 and County Road 222.

Commissioner Yarbrough made the motion for the County to donate $5,000.00 for installation of traffic control lights at the intersection of Al 69 and County Road 222. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

NEXT REGULAR COMMISSION MEETING AUGUST 8, 2005 ADJOURN

 

 Chairman kitchens announced the next regular Commission Meeting will be Monday, August 8, 2005 at 10:00 am in the County Commission Office Conference Room.

 

PUBLIC COMMETS

 

Commissioner Williams announced the East Side and West Side Road Department will be working Monday thru Thursday, 10 hour days starting August 1, 2005. We just wanted the public know if they see county vehicles parked on Friday.

 

Gordon Dunagan stated on behalf of the Town of Good Hope he would like to thank the County Commission for the $5,000.00 donation for the traffic signal at the intersection of Al 69 and County Road 222.

 

Brenda Waldrop stated she is an employee of the Revenue Commissioners Office, working out of the Dodge City Annex. She has been out on sick leave time and the doctor has released her to come back to work, but has not been notified from the Revenue Commissioner when to return.
