COMMISSION MEETING – September 12, 2005
A regular meeting of the Cullman County Commission was held on Monday, September 12, 2005, at 10:00 a.m., in the County Commission Office Conference Room. Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough. Chairman Kitchens called the meeting to order and welcomed the visitors. Attorney, Dan Willingham gave the invocation and Chairman Kitchens led the pledge of allegiance.
APPROVE MINUTES OF
AUGUST 22, 2005 MEETING
Commissioner Yarbrough made the motion to approve minutes of the August 22, 2005 meetings as recorded. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
APPROVE
APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE, ETC.
Commissioner Yarbrough made the motion to approve appropriations, expenditures, requisitions, travel expense, etc. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

JOURNAL ENTRIES TO BE POSTED
Commissioner Yarbrough made the motion to approve all journal entries to be posted. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
PROCLAMATION OF EXISTENCE
OF LOCAL EMERGENCY
Phyllis Little, EMA Director stated this is in connection with Hurricane Katrina. The county needs to have in place a Proclamation of Existence of Local Emergency in place for FEMA for our response and recovery. This is effective as of August 28, 2005.
Commission Williams made the motion for the Proclamation of Existence of Local Emergency. Commissioner Yarbrough seconded, and upon a voice vote, the motion passed unanimously.
PROCLAMATION TO
TERMINATE A LOCAL EMERGENCY
Ms. Little stated this is a Proclamation to Terminate a Local Emergency dated September 7, 2005.
Commission Williams made the motion to Terminate a Local Emergency. Commissioner Yarbrough seconded, and upon a voice vote, the motion passed unanimously.
CONSIDER APPROVING
COBB FAMILY CEMETERY
Chairman Kitchens stated the Cobb Family Cemetery is located off County Road 1114. The Cullman County Health Department has already approved the cemetery.
Commission Williams made the motion to approve the Cobb Family Cemetery. Commissioner Yarbrough seconded, and upon a voice vote, the motion passed unanimously.

BID NO, 819 PRINTERS
Lori Beckhart with Data Processing stated Bryan Business was the low bidder for printers and recommended awarding the bid to Bryan Business.
Commission Williams made the motion to award Bid No. 819 to Bryan Business. Commissioner Yarbrough seconded, and upon a voice vote, the motion passed unanimously.

BID NO. 820 COMPUTERS
Ms. Beckhart stated three qualified bids were received. It’s my recommendation to award the Monitor’s to Electric Booth a local company within the 3% and the computers to Shea PC.
Commissioner Yarbrough made the motion to award Bid No. 820 to Electric Booth and Shea PC. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
CONSIDER AWARDING
BID NO. 821 MODULAR FURNITURE FOR CULLMAN COUNTY EMERGENCY OPERATIONS CENTER
Phyllis Little stated the EMA Office received a $12,000.00 grant from the State for EOC enhancements for work stations and additional TV monitors. Two bids were received and I recommend awarding the bid to Bryan Business.
Commission Williams made the motion to award Bid No. 821 to Bryan Business. Commissioner Yarbrough seconded, and upon a voice vote, the motion passed unanimously.
RESOLUTION NO.
2005-54 TO APPLY FOR FY 2006 TRANSPORTATION ENHANCEMENT APPLICATION
Sammie Danford with the Economic Development Office stated this resolution is to apply for an application for renovations to the old Prison Camp if we qualify for the funding. Funding will be at an 80/20 match.
Commissioner Williams made the motion to apply for the application. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
EMA DIRECTOR –
OVERTIME
Chairman Kitchens stated the EMA Director is an FLSA exempt overtime employee, with the exceptions of overtime in emergence instances where the Federal or State will reimburse overtime amounts.
Commissioner Williams made the motion to pass Resolution No. 2005-56 for overtime pay for the EMA Director. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
RESOLUTION NO.
2005 – 55 RETIREES COST OF LIVING INCREASE
Gary Teichmiller, County Administrator stated the last raise the retirees received was in 2002. The State has offered a 4% increase to retirees in the retirement system. The 4% increase will cost the county approximately $32,000.00.
Commissioner Williams made the motion to pass the increase. Commissioner Yarbrough stated he would like to table the increase for further review. Commissioner Williams with drew his motion and seconded the motion to table for further review, and upon a voice vote, the motion carried unanimously.

COMMISSION MEETING SEPTEMBER 26, 2005
Chairman Kitchens announced the next Commission Meeting will be September 26, 2005 at 10:00 am in the Commission Office conference room.
PUBLIC COMMENTS
Chairman Kitchens announced a Public Meeting will be held by the County Commission on September 22, 2005 at Baileyton Town Hall at 7:00 pm.
Chairman Kitchens stated the Commission needs to consider passing a motion to put the Home Rule Bill on the ballot next year for the people to vote on.
Jack Trawick – Stated his concerns against the closing of County Road 96. The majority of the residents in Castle Rock are against the closing of this road.
Phyllis Little – Cullman County has been approved for public assistance which will cover infra structure damages from hurricane Katrina and emergency response expenses. There will be an applicants briefing tomorrow in Hamilton at 10:00. This covers a 100% of the approved cost for debri removal and emergency protection measures incurred for a 60 period following the declaration dated August 29, 2005. All other categories will be 75/25 reimbursement.
Also, the State EMA has requested mutual aid from Cullman County in scheduling me to work one week service in the disaster recovery center in either Baldwin County or Mobile County no date has been set at this time.
Philip Widner – Gave an update on the Road Department’s gasoline expenses and the increase in paving material due to the increase in fuel prices. Also, gave an update on expenses from heavy rains and hurricane Dennis and Katrina.
Chairman Kitchens – stated a memo was send out to departments due to the increase/shortage of gas, effective Monday, September 12, 2005 Departments will begin driving their personal vehicles to and from work.
The only exception to this will be road department supervisors.
