COMMISSION MEETING

OCTOBER 20, 2005

 

 

CALL TO ORDER AND WELCOME

 

A regular meeting of the Cullman County Commission was held Thursday, October 20, 2005 at 10:00 a.m., in the County Commission Office Conference Room. Chairman Kitchens called the meeting to order and welcomed all visitors.

 

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE

 

Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough. Attorney, Dan Willingham gave the invocation and Chairman Kitchens led the pledge of allegiance.

 

APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED

 

Commissioner Yarbrough made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

NEW BUSINESS

 

            a. Consider to begin process of abandoning County Road 42

            Philip Widner, County Engineer explained County Road 42 is a dead end road that goes into the Archie Williams             property. The Coal Company has purchased all the surrounding property on this road for mining. Mr. Yarbrough and I    have met with the Coal Company on site and they have provided all the necessary deeds. Based on all the information             provided I recommend the county precede with abandoning County Road 42.

            Commissioner Yarbrough made the motion to proceed with abandoning County Road 42. Commissioner Williams             seconded, and upon a voice vote, the motion passed unanimously.

 

            b. Consider release of $20,000.00 Surety Posted for The Village at Simpson Shores

                and acceptance of road (County Road 2001)

            Mr. Widner stated this Subdivision is located off County Road 109. The Developer Joel Underwood has completed all         paving and I recommend the releasing the bond.

            Commission Yarbrough made the motion to release the bond. Commissioner Williams seconded, and upon a voice             vote, the motion passed unanimously.

 

            c. Consider release of $100,000.00 Surety Posed for Arrowhead Pointe Subdivision

                and acceptance of roads (County Road 229 & 299)

            Mr. Widner stated the Developers, Alabama Land Partners has completed the paving in Arrow Pointe Subdivision and I              recommend releasing the bond.

            Commissioner Yarbrough made the motion to release the bond for Arrow Pointe Subdivision. Commissioner Williams             seconded, and upon a voice vote, the motion passed unanimously.

 

            d. Consider release of $220,000.00 Surety Posted for Misty Shores Subdivision and

                acceptance of roads (County Roads 103 & 113)

            Mr. Widner stated the Developers, Alabama Land Partners has completed the paving in Misty Shores Subdivision and I              recommend releasing the bond.

            Commissioner Yarbrough made the motion to release the bond for Arrow Pointe Subdivision. Commissioner Williams             seconded, and upon a voice vote, the motion passed unanimously

 

            e. Library Board Appointment – Williams

            Commissioner Williams made the motion to reappoint Dr. Dan Scott to the Library Board for a 4 year term.             Commissioner Yarbrough seconded, and upon a voice vote, the motion passed unanimously.

 

            f. Consider ADS Security System Proposal

            Mr. Teichmiller, County Administrator explained what ADS Security looked at for the courthouse is fire and security.                        One is fire alarm system with notification of ADS, a card access scanning system, and to increase the camera             monitoring of the courthouse outside. Total cost is approximately $53,439.00.

            Chairman Kitchens stated that a grant for $80,000.00 was obtained from the EMA thru Homeland Security.

            Commissioner Williams stated the remaining balance from the grant would be used for purchasing scanning equipment.

            Commissioner Williams made the motion to sign the proposal from ADS security. Commissioner Yarbrough seconded,             and upon a voice vote the motion passed unanimously.

 

            g. Consider surplus items for Westside Road Department

            Commissioner Yarbrough made the motion to surplus equipment. Commissioner Williams seconded, and upon a voice             vote, the motion passed unanimously.

 

OLD BUSINESS

 

a.      Consider accepting County Road 31

Commissioner Yarbrough stated only one property owner has yet to sign the right of way forms for County Road 31. When this signature is obtained the county will assume maintenance on this road under the new standards.

 

b.      Real Estate Holdings

 

Mr. Willingham updated the Commission on the parcels of property the Commission is looking at to sell. One is approximately 5 acres in the City of Cullman located on St. Joseph St., a lot that lies east across the street from the old hospital, one parcel of land where the old Health Department was located, one parcel where the Board of Education was located, and a parcel just south of the new County Jail. I have spoken with several individuals that seem interested. I have maps, plats and appraisals if anyone else is interested in these pieces of property.

 

 

NEXT REGULAR COMMISSION MEETING MONDAY, NOVEMBER 14, 2005

 

Chairman Kitchens announced the next regular Commission Meeting will be Monday, November 14, 2005 at 10:00 a.m. in the County Commission Conference Room.
