CULLMAN COUNTY COMMISSION MEETING

NOVEMBER 14, 2005

 

 

CALL TO ORDER AND WELCOME

A regular meeting of the Cullman County Commission was held Monday, November 14, 2005 at 10:00 a.m. in the Commission Office Conference Room. Chairman Kitchens called the meeting to order and welcomed all visitors.  

 

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE

Present were Chairman Wiley Kitchens, Commissioner Stanley Yarbrough and Commissioner Doug Williams. Dan Willingham, Attorney gave the invocation and Chairman Kitchens led the pledge of allegiance.

 

APPROVE MINUTES OF OCTOBER 20, 2005 MEETING, APPROVE APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE, AND APPROVE ALL JOURNAL ENTRIES TO BE POSTED

Commissioner Yarbrough made the motion to approve appropriations, expenditures, requisitions, travel expense and all journal entries to be posted. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

PRESENTATIONS

Phyllis Little, EMA Director presented certificates to six law enforcement officers from the Sheriff’s Department that provided mutual aid in South Alabama after the land fall of Hurricane Katrina. Those officers were: Tim Creel, Scott McDonald, G.W. Parker, Josh Smith, Dan Hardy and Andy Ray.

 

 NEW BUSINESS

 

            a. Consider surplus a 1992 Ford F350 – West Side Road Department

            Commissioner Yarbrough stated the 1992 Ford F350 was surplus in October of this year. The Volunteer Fire   Association has expressed a need for this vehicle. I make the motion to transfer the 1992 Ford F-350 to the Fire    Association. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

            b. Park and Recreation Retirees

            Mr. Willingham, County Attorney stated the County took over the operations of the Park and Recreation from the Park             and Recreation Board in           of 2005. The     Park System has retirees that are under the Alabama Retirement System. A         request from the Retirement System has been made for the county to bring those retirees from the Park and Recreation into the county system to be able to obtain all the benefits of the retiree.  At this point they are still the Boards retirees, but if the Board dissolves they will no longer be under the Board.

            Commissioner Williams made the motion to bring the retirees into the county system. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

            c. Consider approval of Preliminary Plat for White Oak Estates located in District 3 off Sand Stone Drive

             County Engineer Philip Widner stated that White Oak Estates is located in Cullman County off Sand Stone Drive,         which is located in Marshall County. The preliminary plat submitted meets all criteria. It’s my recommendation to       approve the preliminary plat for White Oak Estates.

            Commissioner Williams made the motion to approve the preliminary plat. Commissioner Yarbrough seconded, and        upon a voice vote, the motion carried unanimously.

 

            d. Consider approval of Final Plat and Acceptance of the road (Co. Rd. 389) for Parkview Subdivision located in            District 2 off County Road 386.

            Mr. Widner explained that Parkview Subdivision is adjacent to Smith Lake Park. At this time all base and paving is        complete. It’s my recommendation to approve the final plat for Parkview Subdivision and except it into the county            maintenance system.

            Commissioner Yarbrough made the motion to approve the Final Plat for Parkview Subdivision. Commissioner   Williams seconded, and upon a voice vote, the motion passed unanimously.

 

            e. Consider awarding Bid No. 822 Jail Supplies

            Sheriff Tyler Roden stated he had spoken with Lt. Bugler concerning the jail supply bid. At this time we would like to     table this item for further review.

            Commissioner Williams made the motion to table this item. Commissioner Yarbrough seconded, and upon a voice         vote, the motion carried unanimously.

 

            f. Authorize Chairman to sign Agreements with outside agencies receiving appropriations

            County Attorney Dan Willingham stated the County Commission provides funding to various agencies. To clarify how    these appropriations are spent to benefit the citizens of Cullman County, we are looking at a contract that states the services provided. This will authorize the Chairman to sign contracts with agencies already budgeted.

            Commissioner Williams made the motion to table this item until everyone has a chance to look at the contract.    Commissioner Yarbrough seconded, and upon a voice vote, the motion was tabled.

 

            g. Consider awarding Bid No. 823 one or more 6 cu. yd. refuse truck – Sanitation

            Mr. James Rollo, director of the Sanitation Department stated this is for two small sanitation trucks. We received four    bids that meet county specs. Low bidder was Consolidated Disposal with a bid of $68,166.65 with a full five year   warranty on everything. I recommend accepting this bid.

            Commissioner Williams made the motion to accept the low bid. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

            h. Consider awarding Bid No. 824 one or more front loading refuse truck – Sanitation

            Mr. Rollo explained the bid is for a front end loader truck for the Sanitation department. Two bids were received.          Nextram was the low bidder with a bid of $169,106.00 with a five year extended warranty on the engine and     transmission.

            Commissioner Williams made the motion to accept the low bid. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

            i. Consider awarding Bid No. 825 Bituminous Plant Mix

            Mr. Widner, County Engineer stated this is an annual bid, only three bids were received. Shelby Contracting was the      low bidder. I recommend awarding the bid to Shelby Contracting.

            Commissioner Yarbrough made the motion to award the bid to Shelby Contracting. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

            j. Consider awarding Bid No. 826 Various Computer Hardware

            Joey Martin, IT Supervisor stated due to the Holiday no bids were received.

 

k.      Consider accepting County Road 351 into the county’s maintenance system

Commissioner Yarbrough stated county road 351 is not in the county maintenance system. We have spoke to all the land owners they have all agreed to come in compliance with the new regulations to bring roads into the system. I recommend that we bring county road 351 into the county maintenance system, contingent upon the purchase of drainage pipe.

Commissioner Yarbrough made the motion to accept county road 351 into the maintenance system contingent upon the purchase of the drainage pipe. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

REPORTS FROM

      a. David Bussman – Water Department

      Mr. David Bussman, Manager of the Cullman County Water Department stated they had been awarded a CDBG Grant            for Morgan County for $400,000.00. We had previously pledged $100,000.00 in cash, but with the cost of materials,             fuel and items being omitted we’re looking at another $200,000.00 out of pocket to put this project in. If the      commission agrees, the Water Department will use its forces and equipment for this project and use the grant money          for materials.  

 

            b. James Rollo – Sanitation Department

            Mr. Rollo stated his business was awarding the bids for the Sanitation Trucks.

 

PUBLIC HEARINGS

      Chairman Kitchens state the next Town Hall Meeting will be December 1, 2005 at 7:00 pm at the Holly Pond Town      Hall.  The Public is invited to attend.

 

DISCUSSION ITEMS BY COMMISSIONERS

a.      Discuss Thursday Work Session

Chairman Kitchens stated it had been discussed having a work session on Thursday before the commission meetings. This will eliminate everything except coming to the commission meeting, the agenda would be established. Any departments can address the commission; it would be a more informal meeting.

 

b.      Commissioner Yarbrough stated he had a call pertaining to someone being refused an application as a vendor at a park event. Commissioner Yarbrough ask that Chairman Kitchens being over the parks to check this out.

 

NEXT COMMISSION MEETING NOVEMBER 28, 2005

      Chairman Kitchens announced the next commission meeting will be Monday, November 28, 2005 at 10:00 am in the     County Commission Office Conference Room.
