CULLMAN COUNTY COMMISSION MEETING
January 9, 2006
CALL TO ORDER
AND WELCOME
A regular meeting of the Cullman County Commission was held Monday, January 9, 2006 at 10:00 a.m. in the Commission Office Conference Room. Chairman Kitchens called the meeting to order and welcomed all visitors.
CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Stanley Yarbrough and Commissioner Doug Williams. Dan Willingham, Attorney gave the invocation and Chairman Kitchens led the pledge of allegiance.
APPROVE MINUTES OF DECEMBER 27, 2005
MEETING, APPROVE APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE,
AND APPROVE ALL JOURNAL ENTRIES TO BE POSTED
Commissioner Yarbrough made the motion to approve appropriations, expenditures, requisitions, travel expense and all journal entries to be posted. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
PUBLIC COMMENTS
Doug Earnest – Concerned about cable television not being available in the North Vinemont area.
PRESENTATIONS
Chairman Kitchens stated we have two young men from Cullman County who have given the greatest sacrifice ever expected. For the soldiers it was a question of duty and service, for the families it a question of why. Chairman Kitchens quoted John 15: 12-13, according to Chairman Kitchens Mr. Nelson’s sacrifice related to this quote.
Commissioner Williams read the proclamation and presented it to Mr. Nelson’s mother Janice Galin.
Chairman Kitchens ask to table the presentation to the Fales Family until January 23, due to the Fales family being unable to attend the meeting. Commissioner Williams made the motion to table the presentation. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
NEW BUSINESS
a.
Consider the
release of surety bonds and acceptance of the roads for Lakeshore West Phase VI
(C.R. 120) and Phase VII (C.R. 123) located in District 2.
Commissioner Yarbrough made the motion to release the surety bonds. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
b.
Consider acceptance
of the roads in Lakeshore West Phase I and Phase II (C.R. 131,132, 142, 163,
and 182) located in District 2.
Commissioner Yarbrough made the motion to accept the roads in Lakeshore West Phase I and Phase II into the County maintenance system. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
c.
Authorize
contracting with Richie Brothers Auctioneers for sale of Mack Trucks.
County Engineer Philip Widner made the recommendation to contract with Richie Bros for the sell of six Mack trucks and one lowboy truck, with the guarantee gross price of $710,000.00 for the sell of all seven trucks.
Commissioner Williams made the motion to contract with Richie Bros. for the sell. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
d.
Bid No. 828 –
Grader Blades
Philip Widner, County Engineer stated four bids were received based on the estimated quantities used per year. Low bidder was Tractor and Equipment of Decatur, Alabama with a bid of $14,029.50. It’s my recommendation to award the bid to Tractor and Equipment.
Commissioner Williams made the motion to award Bid No. 828 to Tractor and Equipment. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
e.
Bid No. 829 –
Traffic Striping
Mr. Widner stated two bids were received for traffic striping. I recommend award the traffic striping bid to J.C. Check Contractor.
Commissioner Williams made the motion to award Bid No. 82 to J.C. Check Contractors. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
f.
Bid No. 830 –
Concrete
Mr. Widner stated two bids were received for concrete. I recommend awarding the bid to DCA Ready Mix of Cullman with a bid price of $88.00 per cubic yard.
Commissioner Williams made the motion to award Bid No. 830 to DCA Ready Mix. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
g.
Bid No. 831 –
Concrete Pipe
Mr. Widner stated only one bid was received for concrete pipe. I recommend awarding the bid to Hanson Pipe.
Commissioner Yarbrough made the motion to award Bid No. 831 to Hanson Pipe. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
h.
Bid No. 832 –
Guardrail
Mr. Widner stated only one bid was received from Alabama Guardrail of Pinson, Alabama. It’s my recommendation to award the bid to Alabama Guardrail.
Commissioner Yarbrough made the motion to award Bid No. 832 to Alabama Guardrail. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

Bid No. 833 –
Batteries
Mr. Widner stated three bids were received for batteries. It’s my recommendation to go with Stewarts, the lowest responsible bidder.
Commissioner Williams made the motion to award Bid No. 833 to Stewarts. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
j.
Agreement for
Garage Services
Mr. Willingham, County Attorney stated he had been ask to draw up an agreement for the County Garage to provide services to the municipalities.
Commissioner Williams made the motion to use the contract to allow municipalities to use the services of the county garage. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
Chairman Kitchens made the motion to recess the meeting for 10 minutes. Commissioner Williams seconded.
OLD BUSINESS
a.
Surplus 2005 Mack
Lowboy
Mr. Widner asks the Commission to consider the surplus of a 2005 Mack CB713 lowboy last digits of the serial number 24546 effective today.
Commissioner Yarbrough made the motion to surplus the 2005 Mack lowboy. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

Meeting Monday, January 23, 2006 at 10:00 am.
Chairman Kitchens announced the next Commission Meeting will be Monday, January 23, 2006 at 10:00 am in the County Commission Office Conference Room.
