CULLMAN COUNTY COMMISSION MEETING

CALL TO ORDER AND WELCOME

A regular meeting of the Cullman County Commission was held Monday, January 23, 2006 at 10:00 a.m. in the Commission Office Conference Room. Chairman Kitchens called the meeting to order and welcomed all visitors. 

 

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE

Present were Chairman Wiley Kitchens, Commissioner Stanley Yarbrough and Commissioner Doug Williams. Dan Willingham, Attorney gave the invocation and Chairman Kitchens led the pledge of allegiance.

 

APPROVE MINUTES OF JANUARY 9, 2006 MEETING, APPROVE APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE, AND APPROVE ALL JOURNAL ENTRIES TO BE POSTED

Commissioner Yarbrough made the motion to approve appropriations, expenditures, requisitions, travel expense and all journal entries to be posted. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

PUBLIC COMMENTS

 

Fran Willingham – Expressed concerns of employees buying and selling merchandise within the courthouse and Salespeople coming into the courthouse selling merchandise.

 

James Rhodes – requested the Commission to pass a resolution in support of Senate Bill 297.

 

Phyllis Little – informed the Commission and Public of problems with two weather sirens in the Joppa and Welti area. Approximately 30 days to repair.

 

PRESENTATIONS

 

Chairman Kitchens stated Cullman County had two men that lost their live in the line of duty. At this time Commissioner Yarbrough would like to present a proclamation to the Cpl. Adam Robert Fales family.

Commissioner Yarbrough read the proclamation and presented it to Cpl. Fales mother.

 

NEW BUSINESS

 

a.      Consider agreement between the Department of Examiners of Public Accounts and Cullman County Commission for audit of the federal assistance received.

 

County Administrator Gary Teichmiller stated Federal Law requires if grants in excess of $300,000.00 are received, a separate audit is required and performed by the State Examiners for a fee of $6375.00. This is a standard agreement and I recommend the county except this agreement.

Commissioners Williams made the motion to authorize the Chairman to sign the agreement. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

b.      Resolution No. 2006-01 – Authorize Chairman to sign agreement between ALDOT and Cullman County covering construction cost for resurfacing County Road 509.

 

County Engineer Philip Widner stated County Road 509 runs from Garden City to Al. Hwy. 91. Estimated cost of the project is $1,031,650.00 at 80/20 match. I recommend the Chairman to sign this agreement.

Commissioners Williams made the motion to authorize the Chairman to sign the agreement. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

c.       Probate Office – Combine polling place list

 

County Attorney Dan Willingham explained that several Voting Beats in Cullman have more than one box. Several of these boxes do not have sufficient voters to economically justify having more than one box. These boxes can be combined with causing any inconvenience to the voters.

Hanceville City Hall Beat 3 Box 1 and Hanceville City Hall Beat 3 Box 3 be combined to be Hanceville City Hall Beat 3 Box 1.

Jones Chapel Fire Department Beat 15 Box 1 and Jones Chapel Fire Department Beat 15 Box 2 be combined to be Jones Chapel Fire Department Beat 15.

West Point Community Center Beat 17 Box 1 and West Point Community Center Beat 17 Box 3 be combined to be West Point Community Center Beat 17 Box 1.

Holly Pond Town Hall changed to be designated as Holly Pond Fire Department and Holly Pond Town Hall Beat 22 Box 1 and Holly Pond Town Hall Beat 22 Box 2 be combined to be Holly Pond Fire Department Beat 22.

Grandview Community Center Beat 29 Box 1 and Grandview Community Center Beat 29 Box 2 be combined to be Grandview Community Center Beat 29.

Kelly Community Center Beat 30 Box 1 and Kelly Community Center Beat 30 Box 2 be combined to be Kelly Community Center Beat 30.

Commissioner Williams made the motion to combine the polling place list. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

d.      Probate Office – Change wording on Beat 8 polling place

e.      Probate Office – Change of location on 4 Beat Boxes

 

County Attorney Dan Willingham stated he combined d and e into one resolution. The Cullman County Commission with the Probate Judge have reviewed all of the requested changes and find that there are no inconveniences to the voters in the various Beats and the locations and the changes are recommended are to the best interest and benefit of the citizens.

Holly Pond Town Hall voting location be moved from the Holly Pond Town Hall to the Holly Pond Fire Department, being Beat 22 Box 1 and Beat 22 Box 2.  By separate Resolution Beat 22 Box 1 and Beat 22 Box 2 are being combined into one Beat with no boxes and therefore Beat 22 shall be known ad Holly Pond Fire Department Beat 22.

Antioch Community Center Beat 8 be changed only in designation to become Beat 8 Community Center. Change is conducive to let the voters in the particular Beat be more congnisence of the area for which that Beat serves. 

Bremen Community Center Beat 10 location has been moved to the Bremen Fire Department and that said designation be for the Bremen Fire Department Beat 10.

Commissioner Williams made the motion and Seconded by Commissioner Yarbrough, and upon a voice vote, the motion carried unanimously.

 

f.        Probate Office – Approve for new handicap voting machines

 

Greg     with Election Systems and Software explained that this is a Federal mandate by the Help America Vote Act for voters with disabilities to vote a ballot unassisted. This system is designed to provide privacy and accessibility to voters who are blind, vision impaired, or have a disability or condition that would make it difficult or impossible to mark a ballot in the usual way. Federal Funds are already in the state for counties to be reimbursed.

Mr. Willingham stated each machine cost $6025.00. Cullman County has 53 Beats and one machine will need to be placed at each Beat.

Commissioner Williams made the motion to purchase the AutoMARK Voter/87000 voting machines. Commissioner Yarbrough seconded, and upon a voice vote the motion carried unanimously.

 

g.      Consider approval to order seven Mack trucks

 

County Engineer Philip Widner explained the county needs to order new trucks for the next fiscal year 10-11 months in advance to have delivery by January of 2007. The new bid price for the 2007 Mack trucks is $89,500.00.

Commissioner Yarbrough made the motion to order 8 or less Mack trucks. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

OLD BUSINESS

 

  1. EMA – Volunteer Fire Departments Mutual Aid Agreement

 

EMA Director Phyllis Little stated they have 100% participation from the 26 Volunteer Fire Departments in Cullman County and County Fire Association.

 

NEXT REGULAR COMMISSION MEETING MONDAY, FEBRUARY 13, 2006

 

Chairman Kitchens announced the next regular commission meeting will be Monday, February 13, 2006 at 10:00 am in the Cullman County Commission Office Conference Room.
