COMMISSION MEETING

March 13, 2006

 

 

CALL TO ORDER AND WELCOME

A regular meeting of the Cullman County Commission was held Monday, March 13, 2006 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.

 

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE

Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough. Attorney Dan Willingham gave the invocation and Chairman Kitchens led the pledge of allegiance.

 

APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED

Commissioner Yarbrough made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted.  Commission Williams seconded, and upon a voice vote, the motion carried unanimously.

 

 

PUBLIC COMMENTS

 

Mr. Dalton Sellers – Stated he was here today concerning the county taking over County Road 451.

 

NEW BUSINESS

 

Consider awarding bid for Radio Antenna Tower

County Administrator Gary Teichmiller stated this is a self supporting radio tower to be located at the new Cullman Correctional Facility. Only one responsible bid was received with a bid price of $84,723.55. The 911 Board stated they would pay a difference to get the tower down to $78,000.00. I recommend awarding the bid to Sharp Communication.

Commissioner Williams made the motion to award the bid. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Authorize the purchase of Medical Records Software

Mr. Teichmiller stated this is an electronic medical records system. The county agreed with CRMC that we would install this software when the county entered into an agreement with them. The cost of the system is $19,050.00 and a monthly cost of $125.00. I recommend we award the medical records system to Systemedx Healthcare Technology.

Commissioner Williams made the motion to purchase the medical records software. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Consider rejecting bids for CARTS building

Joyce Echols with CARTS stated all bids received exceeded the appropriated funds available for the new CARTS facility. After the commission rejects these bids, upon approval by ALDOT the bids can then be released to the public for bid.

Commissioner Williams made the motion to reject the bids. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Consider awarding Bid No. 832 Metal Pipe

Philip Widner, County Engineer stated two bids were received. I recommend awarding the bid to Contect Pipe.

Commissioner Williams made the motion to award the bid to Contect Pipe. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Resolution No. 2006-09 Reduce speed on County Road 420 to 30 MPH

Mr. Widner stated the current speed limit is 45 MPH. Based on the horizontal and vertical curves in the road I recommend reducing the speed to 30 MPH.

Commissioner Yarbrough made the motion to reduce the speed to 30MPH. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

Consider change in contract with Craft for Lighting Protection System at Cullman County Correctional Facility/Office

Mr. Teichmiller stated the change in the contract to install the Lighting Protection System for the Cullman County Sheriff’s Office and the Cullman County Correctional Facility is a Federal requirement which relates to the 911 center that will be at this location. The change request in the contract is in the amount of $47,864.00. I recommend the approval of the change.

Commissioner Yarbrough made the motion to approve the change in the contract. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

Consider granting a design speed various for The Bluffs at Brushy Pond

County Engineer Philip Widner stated the Design Group of Jasper has submitted a request for a speed variance to 20 MPH, due to vertical curves that will not meet the criteria for 30 MPH design speed. After inspecting, I recommend we grant the 20 MPH speed variance for The Bluffs at Brushy Pond.

Commissioner Yarbrough made the motion to grant the design speed variance. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

Consider change of voting location in the New Canaan area

Probate Judge Betty Brewer stated the change in the voting location for the New Canaan area is due to the present building being too small.

Commissioner Williams made the motion to change the location for the New Canaan voting. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

 

 

            Authorize Chairman to sign Lease Agreement for New Canaan Voting Facility

Commissioner Williams made the motion to authorize the Chairman to sign lease agreement for the New Canaan Voting Facility. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Chairman Kitchens with the consent of the Associate Commissioners ask the County Attorney to negotiate a price for purchasing property in the New Canaan area to be used as a voting site.

Commissioner Yarbrough made the motion to surplus the items listed. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

Board appointment 310 Authority – Commissioner Yarbrough

Commissioner Yarbrough made the motion to appoint Beverly Wilkerson to the 310 Authority with the 6 year term ending April 1, 2012. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

Commissioner Williams made the motion to reappoint Pamela Nail to the 310 Authority with the 6 year term ending April 1, 2012.

Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Consider approving agreement between Cullman County Commission and ALDOT for construction cost on Project IAR-022-000-007 (Co. Rd. 715)

Mr. Widner stated this is also to authorize the Chairman to sign the agreement if approved by the commission. This is the Industrial Access Grant Commissioner Williams has obtained along with the Economic Development Office in the amount of $1,579, 800.00.

Commissioner Williams made the motion to authorize the Chairman to sign the agreement. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Authorize the Chairman to sign Concurrence letter with ALDOT on Project STPNU-2204 (200)

Mr. Widner stated this project is on County Road 509 it runs from Garden City to Al Hwy. 91. Project was bid February 22, 2006 with a bid of $932,440.00 the Federal funds obtained for this project is $745,952.00 with a balance of $186, 488.00 which will be the 20% match. Commissioner Yarbrough has obtained at $70,000.00 ST Grant which will be used as matching money. This will leave a balance of $116,488.00. I recommend signing the letter to concur in the award of the contract to Shelby Contracting Company, Inc.

Commissioner Williams made the motion to authorize the Chairman to sign the letter. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

OLD BUSINESS

 

County Road 451

County Attorney Mr. Willingham stated the County has past guidelines to accept roads into the county maintenance system. Mr. Willingham addressed the eleven steps in the guidelines for accepting roads into the maintenance system. In order to accept this road (451) into the maintenance system the commission would have to modify these guidelines.

Chairman Kitchens ask the Engineer to inspect the road and let the residents know what it will take to accept this road into the county maintenance system.

Community meeting Thursday, March 30, 2006 at the Joppa Volunteer Fire Department

Chairman Kitchens announced the commission will hold a community meeting Thursday, March 30, 2006 at 7:00 pm at the Joppa Volunteer Fire Department.

 

Report on the Personnel Handbook

Mr. Willingham stated he is working on the changes to the Personnel Handbook, including the pay scale for the employees and classifications. I hope it will not be long we will have something to look at and vote on.

Chairman Kitchens announced the next regular Commission Meeting Monday, March 27, 2006 at 10:00 am in the County Commission Office Conference Room.
