COMMISSION MEETING

April 10, 2006

 

 

CALL TO ORDER AND WELCOME

A regular meeting of the Cullman County Commission was held Monday, April 10, 2006 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.

 

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE

Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough. Attorney Dan Willingham gave the invocation and Mr. George Mann led the pledge of allegiance.

 

APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED

Commissioner Yarbrough made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted.  Commission Williams seconded, and upon a voice vote, the motion carried unanimously.

 

PUBLIC COMMENTS

 

Mr. George Mann – Addressed the commission concerning the donations for the Iraqi and Afghanistan Memorial. 

 

Mr. James Rhodes – Requesting information on how much county tax money is spent for illegal alien’s health care at the county owned hospital.

 

NEW BUSINESS

  1. Authorize Chairman to sign Memo of Understanding with Department of Agriculture

Commission Williams stated Mr. Ron Sparks, Commissioner of Agriculture has agreed to give the Cullman County Commission $5000.00 to be used for the parking lot at the Agricultural Trade Center.

Commissioner Williams made the motion to authorize the Chairman to sign the Memo of Understanding with the Department of Agriculture. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

  1. Consider awarding Bid No. 845 Aggregate

Philip Widner, County Engineer state three bids were received. I recommend awarding the bid to all three vendors, as the county has in previous years.

Commissioner Williams made the motion to award bid no. 845 to all three vendors. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

  1. Consider Preliminary Plat for the Bluffs at Brushy Pond located in District 2 on County Road 102

Commissioner Williams made the motion to grant the preliminary plat for the Bluffs at Brushy Pond. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

d. Consider granting one (1) year extension for Surety held by Cullman County Commission for Lake Alaqua Subdivision

Commissioner Williams made the motion to grant a one year extension for Lake Alaqua. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

e. Consider the surplus of two (2) vehicles from Sanitation

a.       1996 Mack MR 6886 Vin# 1M2K195C2TM007750

b.      2000 Mitsubishi Vin# JW6CCG1G0YL006156

 

Commissioner Williams made the motion to surplus the vehicles from sanitation. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

OLD BUSINESS

a. Received approval of Cullman County’s application to participate in the National Flood Insurance Program

Phyllis Little, EMA Director stated Cullman County made it’s application in December of 2005  and approved February 27, 2006. This makes Flood Insurance available to the unincorporated areas of Cullman County. 

 

DISCUSSION ITEMS BY COMMISSIONERS

Commissioner Williams recognized Senator Zeb Little and thanked him for being at the commission meeting.

 

Senator little addressed the commission pertaining to the water issue stating that Cullman County needed a second source of water; one option is to go to the Tennessee River. The counties that border the Tennessee River is coming with local legislation to prevent any counties that doesn’t touch the Tennessee River from drawing water from the Tennessee River. We have worked out a compromise deal where there’s a Morgan and Marshall County local bill. In other words an agreement has been work out. The chairman was concern about a Blount County amendment that has went back to the house. If the bill passes we’re protected and if the bill doesn’t pass we’re okay. Currently we can draw water from the Tennessee River if that’s what the city or commission decides to do.  We’re not going to be able to get water within a year, this is a future option that’s left up to the county and city government. The city and county came to Montgomery and worked with us trying to work out a compromise and I appreciate them coming to Montgomery. We did get the Morgan county bill amended, so if it passes we’re okay or if doesn’t pass we’re okay.

Chairman Kitchen announced the next commission meeting will be Friday, April 21, 2006 at 10:00 am.
