COMMISSION MEETING

June 26, 2006

 

 

CALL TO ORDER AND WELCOME

A regular meeting of the Cullman County Commission was held Monday, June 26, 2006 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.

 

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE

Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough. Attorney Dan Willingham gave the invocation and Commissioner Yarbrough led the pledge of allegiance.

 

APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED

Commissioner Yarbrough made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted.  Commission Williams seconded, and upon a voice vote, the motion carried unanimously.

 

PUBLIC COMMENTS

 

Thomas Dean addressed the commission concerning the paving of County Road 109. Mr. Dean stated the road department only put down tar and gravel and the road would not hold up. Also, Mr. Dean stated the commissioner had told him County Road 226 and County Road 225 would be paved two years ago.

 

Larry Hamilton stated a year ago he had called concerning County Road 1196 being fixed. At this time nothing has been done. Mr. Hamilton also asks the question, was priorities set to pave roads and could the citizens come and look at a chart on the status of their road.

 

NEW BUSINESS

 

  1. Resolution No. 2006-17 Weight Limit on portions of County Road 509

County Engineer Philip Widner said at this time he would like for the commission to table this item until the commissioners can look at this road. County Road 509 was recently paved using federal funds. I recommend setting a weight limit of 7 tons per axle on a portion of County Road 509 beginning at the intersection of County Road 508 over to Garden City.

 

  1. Consider awarding Bid No. 854 Beverage Service for Parks

Robbie Camp, Director of Park and Rec. stated only one bid was received. I recommend awarding the bid to Pepsi.

Commissioner Williams made the motion to award the bid to Pepsi. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

  1. Consider awarding Bid No. 855 Truck mounted refuse container carrier

James Rollo, Manager of the Cullman County Sanitation Department, stated this is for the truck that delivery’s the dumpsters out into the county. This will be replacing a 1985 model. Mr. Rollo stated five bids were received with Southland International being the low bidder. I recommend awarding the bid to Southland International.

Commissioner Williams made the motion to award the bid to Southland. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

  1. Jason Grimmett

Mr. Grimmett stated this is a 63 acre tract of land located on County Road 332 we’re trying to subdivide.

Mr. Willingham, County Attorney stated this tract is located on the southside of Boar’s Knob Subdivision. Mr. Grimmett is asking the commission for a various in the Subdivision Regulations, if the easement is proven to be a public right of way.

Commissioner Yarbrough made the motion to accept the various in the Subdivision Regulations contingent upon proof of a public access easement.  Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

  1. Resolution No. 2006-18 Sales Tax Holiday

Commissioner Williams made the motion to pass the Sales Tax Holiday when the law goes into effect in August that we give this to the citizens of the county contingent on the day of passage of law.

Mr. Willingham stated the statue says the commission has to pass a resolution 30 days before the first weekend in August. The passage statue states this act shall become effective the first day of the third month after its passage and approval of the Governor. I recommend the passage for it to become effective when the act becomes effective.

Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

OLD BUSINESS

 

  1. Resolution No. 2006-13 Project No. STPAA-NCPD 2210(200) Widening County Road 222 from SR 69 to Industrial Park III

Mr. Widner stated this agreement is a standard agreement permitting ALDOT permission to get on County Road 222 to work and any additional work they have to do outside on any additional joining or intersecting roads.

Commissioner Yarbrough made the motion to sign the resolution. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

 

 

 

 

NEXT REGULAR COMMISSION MEETING JULY 10, 2006 AT 10:00 AM

 

Chairman Kitchens announced the next regular Commission Meeting will be Monday, July 10, 2006 at 10:00 am in the Commission Office Conference Room.

 

DISCUSSION ITEMS BY COMMISSIONERS

 

  1. Chairman Kitchens ask the Commissioners if they needed any supplies/materials, because they have been trying to hold back on spending.

      Both Commissioners stated they needed road maintenance materials (tar and gravel).

 

  1. Public Meeting Thursday, June 29, 2006 at 7:00 pm at the New Canaan Community Center

     Chairman Kitchens announced at public meeting will be held Thursday, June 29 at 7:00 pm at the New Canaan

     Community Center.

Commissioner Williams made the motion to adjourn. Commissioner Yarbrough seconded.
