COMMISSION MEETING
July 10, 2006
CALL TO ORDER AND
WELCOME
A regular meeting of the Cullman County Commission was held Monday, July 10, 2006 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.
CALL OF ROLL TO
ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough. Commissioner Williams gave the invocation and Euell Hodge, President of the Fire Association the pledge of allegiance.
APPROVE MINUTES,
APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL
ENTRIES TO BE POSTED
Commissioner Yarbrough made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted. Commission Williams seconded, and upon a voice vote, the motion carried unanimously.
PUBLIC COMMENTS
Leon Smith – Representing the Arkadelphia Community Center ask the commission for a donation to the Community Center.
Commissioner Yarbrough made the motion to give Arkadelphia Community Center a $1,000.00 donation. Seconded by Commissioner Williams, and upon a voice vote, the motion carried unanimously.
NEW BUSINESS
Old Health Department – 305 4th Ave.
Lot across from old hospital – Corner of Elizabeth St. and 5th Ave.
Property behind Curl Concrete – Beech Ave.
Gary Teichmiller, County Administrator stated the County Attorney is advertising for seal bids on the property.
Commissioner Williams made the motion to surplus the three pieces of property. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
Commissioner Yarbrough made the motion to appoint Brett Adams to the DHR Board due to the resignation of Mrs. Nell Graham. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
County Engineer Philip Widner stated County Road 144 is in the Brushy Pond Area. Subdivision Regulations require a minimum of 30 MPH design speed. Due to the geographic of the land is such that it’s impossible to meet a 30 MPH design speed, I recommend granting a 20 MPH variance.
Commissioner Yarbrough made the motion to grant the 20 MPH speed variance. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Chairman Kitchens announced that a public meeting will be held Thursday, July 13, 2006 from 6:00 pm to 8:00 pm in Judge Chaney’s Courtroom.
Old Business

Resolution No.
2006-17 Weigh Limit on portions of County Road 509
Mr. Widner stated the weigh limit on County Road 509 will begin at the intersection of County Road 508 easterly to Garden City Town limits. This resolution is established at 7 tons per axle or 28 tons gross above which motor vehicles may not be operated.
Commissioner Williams made the motion to pass Resolution No. 2006-17. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
Next Commission Meeting Monday, July 31, 2006
Chairman Kitchen announced the next regular Commission Meeting will be July 31, 2006, at 10:00 am in the Commission Office Conference Room. The meeting was changed from July 24, 2006 due to one of the Commissioner being out of town.

Commissioner Yarbrough made the motion to adjourn. Commissioner Williams seconded.
