COMMISSION MEETING

August 28, 2006

 

CALL TO ORDER AND WELCOME

A regular meeting of the Cullman County Commission was held Monday, August 28, 2006 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.

 

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE

Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough and Attorney Dan Willingham. Mr. Willingham gave the invocation and Commissioner Williams lead the pledge of allegiance.

 

APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED

Commissioner Yarbrough made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted.  Commission Williams seconded, and upon a voice vote, the motion carried unanimously.

 

PUBLIC COMMENTS

Jeanette Swann – Lives on County Road 221. Stated the Commission took County Road 221 into the maintenance system several months back requesting the status of this road.

Commissioner Yarbrough stated there were problems on the right of way for the cul-de-sac. The county will do the work but it will take some time.

 

NEW BUSINESS

Authorize Chairman to sign NARCOG Senior Aide Program Agreement

Mr. Randall Shedd, Director of The Commission on Aging stated this is the standard annual agreement between the Commission and NARCOG. In order for the county to have employees that can work up to 19พ hours and paid by NARCOG the commission will need to approve this agreement.

Commissioner Williams made the motion to authorize the Chairman to sign the annual agreement. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Authorize Chairman to sign the FY 7 Title Aging Contract, the Title III-D Health Prevention/Promotion Contract and the SenioRx Contract for Cullman County.

Mr. Shedd stated this is the annual operating contract where the aging program works. These Federal Funds are authorized by Congress and come thru Federal Agencies to the State of the Alabama Department of Senior Services. The Alabama Department of Senior Service then gives direction to the region and then the region gives directions to us to carry out the aging program. I recommend the commission signing these contracts.

Commissioner Williams made the motion to authorize the chairman to sign the three (3) contracts. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Cullman County Economic Development to present Chairman with plaque recognizing the county as winning the City/County Blood Drive.

Cher with the Economic Development Offices expressed her appreciation for the Commission allowing their office for being the chairperson for the annual City/County blood drive. This is the first time in two (2) years the county has won. We would like to thank all the sponsors for door prizes and those who participated.

 

Attorney Brent Thornley

Mr. Thornley spoke representing Edgewater Land Company. Mr. Thornley submitted two (2) maps to the commission of the proposed subdivision for consideration. Mr. Thornley stated he would be willing to meet at the convenience of the commission to answer any questions.

Chairman Kitchens stated they would meet with Mr. Thornley after the meeting.

 

Consider the surplus of the Kardex filing system – Commission Office

Commissioner Williams made the motion to surplus the filing system. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Consider the surplus of a 1985 Container Deliver Truck – Sanitation Department

Mr. James Rollo, Director of the County Sanitation Department stated this truck is non operational.

Commissioner Williams made the motion to surplus the truck. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Consider $1,000.00 donation to the Brooklyn Community Center.

Commissioner Williams stated he received a letter of request. I would like to make the motion to give Brooklyn Community Center $1000.00 donation. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Resolution No. 2006-23 Assuming maintenance of a portion of US Highway 278 adjacent to Kugler Creek, Project NHF-0074(509).

Philip Widner, County Engineer explained the Alabama Department of Transportation has plans to relocate a portion of US Highway 278 from County Road 403 to East of County Road 1151 and construct a new bridge over Kugler Creek to be designated by the State as Project NHF-0074(509). This project will bypass a section of existing US Highway 278 (SR-74) as and this section will no longer function as a part of the State Highway System. This portion of the bypassed section of US 278 referred to is located in Cullman County. If the County Commission supports this project the County agrees to assume maintenance responsibility of the section of US Highway 278 lying within the jurisdiction of Cullman County that has been bypassed by this project, including the existing bridge. The effective date of this resolution shall be the date that the new highway facility is complete and open to traffic.

Commissioner Yarbrough made the motion to accept the resolution as written. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

 

Authorize Chairman to sign grant for Cullman County Airport – Mr. Bob Burns

Mr. Bob Burns, Manager of the Cullman County Airport (Folsom Field) stated this grant is for $45,000.00. This grant is for reimbursement, the FAA will pay 95% and the City/County will pay 2ฝ%.

Commissioner Williams made the motion to authorize the Chairman to sign the grant. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

OLD BUSINESS

 

Payroll System

Commissioner Williams stated on working with the payroll system for Cullman County, one thing the county needs to do is post changes to the handbook.

Mr. Willingham stated when you make changes to the handbook it will need to be posted for ten (10) days for employees can have the opportunity to review. The commission needs to pass a resolution to post the changes.

Commissioner Williams made the motion to post the changes to the handbook. Commissioner Yarbrough ask when would the Commission be able to have the opportunity to review the changes, he had not seen any written changes yet.

Mr. Willingham stated there will be very little change in the handbook because it refers back to the payroll system.

Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Self Governance

Chairman Kitchens stated the Self Governance Act had been tabled. Chairman Kitchens ask the Attorney to explain what the county could do.

Mr. Willingham stated under the Self Governance statue there are two ways to put the Self Governance Act on the ballot. One is for the commission to pass a resolution to put it on the ballot, or if you have at least 10% of population on petition. Only unincorporated areas may vote.

Commissioner Williams made the motion to place the Self Governance Act on the ballot. Commissioner Yarbrough second, and upon a voice vote, the motion carried unanimously.

 

 

TOWN HALL MEETING THURSDAY, SEPTEMBER 7, AT WEST POINT TOWN HALL

Chairman Kitchens announced the next Town Hall meeting will be Thursday, September 7, 2006 at 7:00p.m. at the West Point Town Hall.

 

NEXT REGULAR COMMISSION MEETING SEPTEMBER 11, 2006

Chairman Kitchens announced the next regular commission meeting will be Monday, September 11, 2006 at 10:00 a.m. in the Commission Office Conference Room.
