COMMISSION MEETING

October 10, 2006

 

CALL TO ORDER AND WELCOME

A regular meeting of the Cullman County Commission was held Monday, October 10, 2006 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.

 

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE

Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough. Attorney Dan Willingham gave the invocation and Commissioner Williams lead the pledge of allegiance.

 

APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED

Commissioner Yarbrough made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted.  Commission Williams seconded, and upon a voice vote, the motion carried unanimously.

 

PUBLIC COMMENTS

 

Sharon Murphree addressed the commission with concerns regarding the Tattoo Business that is opening up across from a church and adjacent to subdivisions.

 

Billy Warren addressed the commission concerning County Road 109 (Calverts Cove) intersecting County Road 230, requesting a sign “Hidden Drive”. Vehicles drive excessive speeds.

 

Jason Murphree requested the commission to check the sign at the Tattoo Business blocking the view when vehicles are pulling out onto the roadway.

 

 

NEW BUSINESS

 

Abatement of Taxes & Litigation – Revenue

Debbie Harden with the Revenue Department stated this is done the first meeting in October and we are asking the commission to abate the taxes in litigation from 2001 there’s nothing left to collect and we need to get them off our books.

Commissioner Williams made motion to abate the taxes. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Authorize Chairman to sign agreements with agencies

Mr. Dan Willingham, County Attorney stated the auditors suggested that the commission needed signed contracts from the different agencies that the commission appropriates money too.

Commissioner Williams made the motion to allow the chairman to sign contracts from agencies. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Consider adopting Standards for construction for the Cullman County Water Department System

Mr. David Bussman, Manager of the Cullman County Water Department stated this is a copy of the standard construction for all water lines in Cullman County, Winston County, and Morgan County. This will hold construction standards to developers the same as we hold our contractors too. I am asking the commission to consider these construction standards.

Commissioner Yarbrough made to motion to accept the construction standards. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Consider the surplus of Kitchen Equipment (old jail)

Terry Morgan with the Sheriff’s Department stated this equipment is no longer being used by the department and needs to be surplus.

Commissioner Williams made the motion to surplus the kitchen equipment. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Resolution No. 2006-29 – Speed Limit on County Road 1163

Philip Widner, County Engineer stated this road has been reconstructed over the past couple of years and it was designed for 30 MPH. I make the recommendation to post County Road 1163 at 30 MPH.

Commissioner Yarbrough made the motion to post County Road 1163 at 30MPH. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

Authorize Chairman to sign architect documents and engineering services on DHR Building

Item was tabled until after meeting with DHR.

 

Consider $1,000.00 donation to voting center at Logan

Commissioner Williams made the motion to donate $1,000.00 to the Logan voting center. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Consider $1,000.00 donation to voting center at Cold Springs

Commissioner Williams made the motion to donate $1,000.00 to the Cold Springs voting center. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Consider $1,000.00 donation to voting center at Bremen

Commissioner Williams made the motion to donate $1,000.00 to the Bremen voting center. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

 

Consider $1,000.00 donation to voting center at Jones Chapel

Commissioner Williams made the motion to donate $1,000.00 to the voting center at Jones Chapel. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Consider the surplus of various parts from County Garage

Commissioner Yarbrough made the motion to surplus the various parts from the County Garage. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

Consider authorizing Chairman to sign agreement with Alabama Power

Commissioner Williams stated Alabama Power has offered to build a new fishing pier at Smith Lake Park for the county. Approximately $45,000.00 all paid for by Alabama Power and no cost to the county. I make the motion to allow the chairman to sign the agreement.

Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

Personnel Handbook

Mr. Willingham stated any proposed changes to the Personnel Handbook need to be posted for ten (10) days. Adoption of the proposed changes will open the door to do the Pay Plan. Mr. Willingham explained the each of the changes.

Commissioner Williams made the motion to adopt the changes in the wording in the Personnel Handbook. Commissioner Yarbrough stated he would like to table this because this is the first time he has had clarification of the changes in the handbook. Chairman Kitchens said it is the pleasure of the commission then to table this till the next commission meeting.

 

OLD BUSINESS

 

Mack Trucks for Road Department

Philip Widner stated in February the commission had approved the purchase of the Mack Trucks so they could get them ordered. The agreement was that we would finish a purchase order after the beginning of the fiscal year. I just wanted to make the commission aware of this. One thing that was left hanging was the purchase of a truck to pull the lowboy. We would like to go ahead and purchase this truck so the county can take delivery of it at the same time we do the Mack Trucks.

Commissioner Williams made the motion to sell the old mack trucks and to purchase the truck/tractor for the lowboy. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

 

NEXT REGULAR COMMISSION MEETING OCTOBER 23, 2006

Chairman Kitchens announced the next regular commission meeting will be Monday, October 23, 2006 at 10:00 am in the Commission Office Conference Room.
