COMMISSION MEETING
October 23, 2006
CALL TO ORDER AND
WELCOME
A regular meeting of the Cullman County Commission was held Monday, October 23, 2006 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.
CALL OF ROLL TO
ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Stanley Yarbrough. Attorney Dan Willingham gave the invocation and Commissioner Williams lead the pledge of allegiance.
APPROVE MINUTES,
APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL
ENTRIES TO BE POSTED
Commissioner Yarbrough made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted. Commission Williams seconded, and upon a voice vote, the motion carried unanimously.
PUBLIC COMMENTS
NEW BUSINESS
Consider approving
the request to establish a private cemetery known as The Sonya Maria Scott
Family Cemetery located at 662 County Road 655, Hanceville
Commissioner Williams made the motion to approve the request to establish a private cemetery. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
Resolution No.
2006-30 Authorizing the Chairman to execute agreement for services with the
Towry Company
Mr. David Bussman, Manager of the Cullman County Water Department stated this resolution is for grant management services for the 2006 CDBG Grant.
Commissioner Williams made the motion to authorize the chairman to sign the resolution for grant services. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

31 Authorizing the Chairman to execute an agreement for engineering Services
Mr. Bussman stated this resolution is for engineering services for the 2006 CDBG Grant.
Commissioner Yarbrough made the motion to authorize the chairman to sign the resolution for engineering services. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Approve drivers for
North Alabama DMORT Truck
Phyllis Little, EMA Director stated the ACCA Office advised at least two people who are members of the team needs to be designated to drive the DMORT Truck. I recommend adding Commissioner Doug Williams who is currently the team leader and Mark West with Fairview Fire Department based on the approval of the Commission. The only other drives are the EMA Director and the Deputy Director who are already covered under county insurance.
Commissioner Yarbrough made the motion to accept the two drivers. Chairman Kitchens seconded, and upon a voice vote, the motion carried unanimously.
Assume maintenance on
Logan Sirens
Ms. Little stated she had received a request from Chief Bud Paden, Logan Fire Department asking the Cullman County EMA and the Cullman County Commission assumes the maintenance and insurance responsibilities on the two sirens at Logan. The community borrowed funds to purchase these two sirens and purchased insurance on the sirens. These sirens seem to be in good working order. We haven’t had any problems since they were installed. I recommend the county to assume the maintenance and insurance.
Commissioner Yarbrough made the motion to assume the maintenance responsibilities. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider awarding Bid
No. 863 – Right-hand Batwing Rotary Cutter
Philip Widner, County Engineer stated this for one or more 10 ft. cutters. Four bids were received, I recommend awarding the bid to Dixie Tractor the 2nd lowest bidder with a bid of $8600.00.
Commissioner Yarbrough made the motion to award the bid to Dixie Tractor contingence upon the attorney speaking to the auditors. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

No. 864 – Sheriff’s Patrol Car
Lt. Terry Morgan with the Sheriff’s Dept. stated every year the Sheriff’s Dept. puts out a bid for patrol cars. Only one was received from Eckenrod Ford in the amount of $20,686.00. I recommend awarding the bid to Eckenrod.
Commissioner Williams made the motion to award the bid to Eckenrod Ford. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.

No. 865 – Computer Equipment
Joey Martian with Data Processing stated four bids were received. I recommend awarding the bid to the lowest bidder Dell.
Commissioner Williams made the motion to accept the bid. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
Consider awarding Bid
No. 866 – 25 cubic yd. rear-loading refuse collection truck with body
Mr. James Rollo, Manager of the Cullman County Sanitation Dept. stated three bids were received. Lowest bid that met all the specs was from Ingram Equipment Company out of Pelham with a bid of $120,252.28. I recommend awarding the bid to Ingram for the purchase of two trucks.
Commissioner Williams made the motion to accept the bid. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
Consider approval of
final plat and acceptance of the road (Co. Rd. 1562) for Oak Lane Subdivision
located in District 3 off County Road 1545 (Goldridge Road)
Philip Widner, County Engineer stated in February of 2006 the commission approved a preliminary plat for this Subdivision. At this time all drainage and road construction has been completed. I recommend acceptance of this road with the developer being responsible for the road for twelve months.
Commissioner Williams made the motion to accept the final plat for the road. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
Consider acceptance
of the road in Robin Park Subdivision located in District 3 off County Road
1435 (Eva Road)
Mr. Widner stated this is a Subdivision that was constructed back in 1990 or 1991, at that time this road was paved. This subdivision has approximately twelve lots. The construction of this road was real good and the pavement has held up, it meets all requirements. This road will fall under the guidelines adopted by the commission several months ago accepting existing road. I recommend the county accept this road.
Commissioner Williams made the motion to accept the road. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
Consider $1,000.00
donation to Baldwin Community Center
Commissioner Yarbrough made the motion to give the Baldwin Community Center a $1,000.00 donation. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider awarding Bid
No. 867 – 6 cubic yd. side loading refuse collection truck with body
Mr. Rollo with the Sanitation Department stated only one bid was received from Conquest Truck in the amount of $77,279.65 with a five year extended warranty. I recommend approving the awarding of the bid.
Commissioner Yarbrough made the motion to award the bid. Commissioner Yarbrough seconded, and upon a voice vote, the motion carried unanimously.
OLD BUSINESS
Personnel Handbook
Mr. Dan Willingham, County Attorney stated the county had posted for several weeks the changes in the Personnel Handbook, with that I have some proposed policies that needs to be put in place with the pay plan. The commission has met with department heads as a group and met with some individual. The commission may want to table this item and look over these policies that go along with the pay plan. These policies may help answer some questions department heads may have.
Commissioner Yarbrough made the motion to table until the 2nd meeting in November. (November 27, 2006) Commissioner Williams seconded the motion.

Commissioner Williams stated it has been his honor and a privilege to server as commissioner the last two years, I would like to thank everyone one for their support and prayers. I would like to thank Commissioner Yarbrough serving with him has been an honor and a privilege. I also want to thank him for being there and helping me and for making things better in Cullman County.

Commissioner Yarbrough stated he would like to thank Commission Williams and Chairman Kitchens for serving with him the last four years. I would like to thank the public, I have made some great friends. This is my last formal commission meeting, it’s been enjoyable and an honor and I would like to thank each one of you.

Chairman Kitchens announced the next regular commission meeting will be Tuesday, November 14, 2006 at 10:00 am in the Commission Office Conference Room.
