COMMISSION MEETING
November 14, 2006
CALL TO ORDER AND
WELCOME
A regular meeting of the Cullman County Commission was held Tuesday, November 14, 2006 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.
CALL OF ROLL TO
ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Wayne Willingham. Attorney Dan Willingham gave the invocation and Chairman Kitchens lead the pledge of allegiance.
APPROVE MINUTES,
APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL
ENTRIES TO BE POSTED
Commissioner Willingham made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted. Commission Williams seconded, and upon a voice vote, the motion carried unanimously.
PUBLIC COMMENTS
Sammie Danford - Announced a reception will be held at the Economic Development Office today at 2:00 p.m. for the newly elected Commissioners.
Carolyn Calvert – Thanked the political candidates for removing their signs off the right of ways.
NEW BUSINESS
Agreement for
Project STPAA-NCPD-2210(200) County Road 222 Widening & Improvements – St
John & Associates
Mr. Dan Willingham, County Attorney stated AT&T needs a Subordination Agreement. AT &T has a specific easement along County Road 222 and part of the roadway will encroach into their easement. AT & T is willing to subordinate that to the county to work within those easements. There are a couple of provisions in this agreement I need to talk with AT&T about but as a whole you need this for the project. I recommend the commission to pass a resolution to allow the Chairman to complete the negations with AT&T and sign the resolution.
Commissioner Willingham made the motion to accept the resolution. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Agreement between
Cullman County Commission and Lee Helms Associates for Services - EMA
Commissioner Williams stated this is an agreement with the Lee Helms Associates. In order for Cullman County to continue receiving Homeland Security Grants and EMA Grants a mock disaster exercise is required. Cullman County EMA has obtained a grant to pay for this service.
Commissioner Williams made the motion to allow the Chairman to sign the agreement with Lee Helms Associates. Commissioner Willingham seconded, and upon a voice vote the motion carried unanimously.
Set Date and Times
for County Commission Meetings
Attorney Willingham stated in 2004 the statue was amended and allowed the County Commissions to modify its meeting times as long as they met monthly.
Chairman Kitchen’s recommended setting meeting times to every second and fourth Tuesday at 10:00 a.m.
Commissioner Willingham made the motion to change meeting times to the second and forth Tuesday at 10:00 a.m. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Add Mr. Wayne Willingham’s
name to all county bank accounts
Commissioner Williams made the motion to add Wayne Willingham’s name to all bank accounts. Chairman Kitchens seconded, and upon a voice vote, the motion carried unanimously.
Resolution
No.2006-32 vacating a portion of County Road 1601
Attorney Willingham stated a public hearing was held Monday, November 13, 2006 if anyone had any comments to be made and also notices has been posted. County Road 1601 loops between Al Hwy. 278 East and Al Hwy. 157.The City of Cullman owns property on both sides and no other abutting property owners and the City is asking the County to vacate this portion of County Road 1601. I have meet with one property owner on this road and it will not affect them, so they had no problem with the vacation.
Commissioner Williams made the motion to vacate that portion of County Road 1601. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Resolution No.
2006-33 Agreement between Cullman County Commission and the State of Alabama –
CARTS
Mr. James Graves, Director of CARTS stated this is an annual agreement that is required between Cullman County and The State of Alabama. The CARTS program accepts Federal money (approximately $250,000.00 ±) that helps subsidies CARTS, which is administrated by the State.
Commissioner Williams made the motion to allow the Chairman to sign the agreement between the Cullman County Commission and CARTS. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Library Board Appointment – Chairman Kitchens
Chairman Kitchens stated he had received a letter asking to reappoint Mr. Ron Hogue to the library board. Chairman Kitchens made the recommendation to reappoint Mr. Hogue.
Commissioner Willingham made the motion to appoint Mr. Hogue to the library board. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Acceptance of gift
Mr. Willingham stated a will has been probated here in Cullman County, specifying two departments (Commission on Aging and Cullman County Animal Shelter) within the County receiving a monetary donation. I recommend to the commission to sign the forms (wavers) to become receipants of this donation.
Mr. Andrew Chambers, executor of Mr. Vinson Kennedy’s estate, stated Mr. Kennedy was a resident of Vinemont, a WWII veteran and still trying to serve his Country today.
Commissioner Willingham made the motion to except the gift. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
OLD BUSINESS
Commissioner Williams stated original it was scheduled to look at the changes to the personnel handbook. I think we need to give Commissioner Willingham a chance to look over the changes before a vote.
NEXT REGULAR
COMMISSION MEETING TUESDAY, NOVEMBER 28, 2006
Chairman Kitchens announced the next regular commission meeting will be Tuesday, November 28, 2006 ay 10:00 am in the Commission Office Conference Room.

Commissioner Willingham made the motion to adjourn. Commissioner Williams seconded.
