COMMISSION MEETING
November 28, 2006
CALL TO ORDER AND
WELCOME
A regular meeting of the Cullman County Commission was held Tuesday, November 28, 2006 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.
CALL OF ROLL TO
ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Wayne Willingham. Attorney Dan Willingham gave the invocation and Chairman Kitchens lead the pledge of allegiance.
APPROVE MINUTES,
APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL
ENTRIES TO BE POSTED
Commissioner Willingham made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted. Commission Williams seconded, and upon a voice vote, the motion carried unanimously.

NEW BUSINESS
Consider awarding
Bid No. 868 – Bituminous Plant Mix
Philip Widner, County Engineer stated four (4) bids were received for bituminous plant Mix. Shelby Contracting was the low bidder with a $7.00 per ton increase from last year. I recommend awarding the bid to Shelby Contracting out of Huntsville, Alabama.
Commissioner Williams made the motion to accept the bid. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Resolution No.
2006-34 Designate Depositories
Mr. Dan Willingham, County Attorney stated by statue the commission annually makes a Resolution which banks the commission will be using for depositories for the County Commission. The commission uses so many of the banks within Cullman County. I recommend the commission make a resolution that any bank in Cullman County can be used as a depository and the ability to the Chairman to establish which accounts go to which banks.
Commissioner Williams made the motion to designate depositories. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Authorize Chairman
to sign contract for property insurance
Mr. Gary Techmiller, County Administrator stated he had received two proposals. The price with St. Paul’s with is thru a local company Smith and Gray are slightly higher but the coverage is greater and also provides blanket coverage for all the vehicles in the county inventory.
Commissioner Willingham made the motion to accept the proposal from Smith and Gray and allow the chairman to sign the contract. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider
authorizing County Attorney to begin vacation procedures for County Road 799 as
requested by adjacent property owners
Mr. Widner stated Count y Road 799 is a small dead end dirt road located in the Holly Pond area between Al Hwy. 278 and Hwy. 91. They are two property owners local on this road and all parties has filed a petition with my office that this road be vacated. I recommend to the commission to ask the County Attorney to begin vacation procedures on this road.
Commissioner Williams made the motion to allow the attorney to begin vacation procedures on County Road 799. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider posting
County Road 783 from State Highway 278 to Blount County Line for “No Thru
Trucks, Local Traffic Only”.
Mr. Widner stated this is a cut off road from 278 to Blountsville. This road was not designed to hold up the amount of truck traffic that is using this road as a cut off. I recommend doing this thru resolution where the county weight crew can enforce the “No Thru Trucks”.
Commissioner Williams made the motion to post the traffic sign. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider granting
an extension until August 1, 2007 for surety held by Cullman County Commission
for Briarwood Estates located on County Road 1277 in District 1.
Mr. Widner stated this County Road is off Old 31 adjacent to I-65 and Mr. Jack Still is the Developer. Mr. Still asks that the commission grant this extension till August 2007 which will give him time to pave Briarwood Estates. I recommend the commission to grant this extension.
Commissioner Willingham made the motion to grant the extension. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider approval
of Final Plat for Overlook at Simpson Creek subject to $25,000 Surety and
contingent on receipt of proper plat with all required signatures. Located in
District #2 on County Road 144
Mr. Widner stated this is in the Brushy Pond area, R&D Properties is the Developers. I recommend approval of the Final Plat for Overlook at Simpson Creek.
Commissioner Willingham made the motion to approve the Final Plat. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider $1,000.00
donation to the Walter Community Center
Commissioner Williams made the motion to donate $1,000.00 to the Walter
Community Center. Commissioner Willingham seconded, and upon a voice vote, the
motion carried unanimously.
OLD BUSINESS
Consider changes
to Personnel Handbook
Mr. Willingham stated these changes are in the Personnel Handbook not in the pay scale. These changes have been posted for some time.
Commissioner Williams made the motion to adopt the changes to the Personnel Handbook. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

Chairman Kitchens announced the next regular commission meeting will be Tuesday, December 12, 2006 at 10:00 am in the Commission Office Conference Room.
