COMMISSION MEETING

December 26, 2006

 

CALL TO ORDER AND WELCOME

A regular meeting of the Cullman County Commission was held Tuesday, December 26, 2006 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.

 

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE

Present were Chairman Wiley Kitchens, Commissioner Doug Williams, and Commissioner Wayne Willingham. Attorney Dan Willingham gave the invocation and Commissioner Williams lead the pledge of allegiance.

 

APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED

Commissioner Willingham made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted.  Commission Williams seconded, and upon a voice vote, the motion carried unanimously.

NEW BUSINESS

 

Consider awarding Bid No. 869 – Heating Fuel

Commissioner Williams made the motion to award bid No. 869 to All Gas. Commissioner Willingham seconded and upon a voice vote, the motion carried unanimously.

 

Resolution No. 2006-38 revised agreement for Project IAR-022-000-007 (county road 715)

Fred Penn, County Engineer stated this project is the industrial access grant for county road 715. The county has received an extension on the grant and this is the revised agreement for the chairman to sign.

Commissioner Williams made the motion to allow the chairman to sign the resolution. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

 

Consider acceptance of County Road 480, 450 and 499 located off County Road 483 in District 4

Engineering Assistant Keith Creel stated these roads was constructed in 1997 and signed off on by Joseph T. Miller a previous County Engineer, on October 20, 1997. These roads were never brought to the commission to be accepted into the system. The roads are asphalted with curve and gutter, the roads were inspected and in good condition. I recommend accepting these roads into the county maintenance systems and road maintenance effective immediately.

Commissioner Williams made the motion to accept the roads into the county maintenance system. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

 

Authorize Chairman to sign agreement renewing county liability insurance

Gary Teichmiller, County Administrator stated this is the annual premium for liability insurance thru the ACCA liability self insurance fund. This is from January 1, 2007 thru January 1, 2008 for $418,951.00.

Commissioner Williams made the motion to allow the chairman to sign the agreement.  Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

 

Consider the surplus of one 1994 Caprice – Park and Rec.) Vin. No. 1G1BL52PaRR154435

Commissioner Williams made the motion to surplus the 1994 Caprice from Park and Rec. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

 

Consider a $1,000.00 donation to the Berlin Community Center

Commissioner Williams made the motion to donate $1,000.00 to the Berlin Community Center. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

 

Water Department Property

David Bussman, manager of the Cullman County Water Department stated the water department is requesting to purchase 25.79 acres in Morgan County. The appraisals have been done and given to the County Engineer, the asking price is $205,050.00. Mr. Bussman stated the money was in the budget to purchase the property.

Commissioner Williams made the motion to purchase the property. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

 

OLD BUSINESS

 

Consider vacating County Road 41

Mr. Dan Willingham, County Attorney stated this had been published in the paper and a public hearing had been held to vacate county road 41. County Road 41 is a loop road off County Road 223 and all property owners had ask for this road to be vacated. Mr. Bussman stated the water department will have their part took care of this week.

Commissioner Willingham made the motion to vacate county road 41. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

 

 

NEXT REGULAR COMMISSION MEETING TUESDAY, JANUARY 9, 2007

 

Chairman Kitchens announced the next commission meeting will be Tuesday, January 9, 2007 at 10:00 a.m. in the Commission Office Conference Room.
