January 23, 2007
CALL TO ORDER AND
WELCOME
A regular meeting of the Cullman County Commission was held Tuesday, January 23, 2007 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.
CALL OF ROLL TO
ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Doug Williams, Commissioner Wayne Willingham and Attorney Matt Carter. Commissioner Williams gave the invocation and Commissioner Willingham lead the pledge of allegiance.
APPROVE MINUTES,
APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL
ENTRIES TO BE POSTED
Commissioner Willingham made the motion to approve minutes, appropriations, expenditures, requisitions, travel expense and all journal entries to be posted. Commission Williams seconded, and upon a voice vote, the motion carried unanimously.
PUBLIC COMMENTS
Wendell Dennis – Addressed the commission concerning County Road 1520. Four families live on this road. Would like the commission to look at this illegal developed subdivision and bring this road into the county maintenance system.
Thomas Dean – Mr. Dean stated he lives on County Road 109. It’s a waste of money to keep patching this road and wanted to know, what is the commission’s intent to properly fix this county road.
Attorney Roy Williams – Stated he is representing Mr. Brian Robinson, Developer. Ask the commission to place County Road 51 and Windmere Condominiums on the agenda for February 13, 2007.
NEW BUSINESS
Consider the surplus
of various office equipment – Revenue
Commissioner Williams made the motion the surplus the various office equipment. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Consider the surplus
of one 1995 Chev. Astro Van – AOA
Commissioner Williams made the motion to surplus the 1995 Astro Van VIN # 1GNDM19W1SB212312. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Consider the surplus
of five Sanitation vehicles
Commissioner Williams made the motion to surplus the five sanitation vehicles and place them on GovDeals to sell. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Authorize Chairman to
sign Memo of Understanding and Invoice with the Department of Agriculture
Commissioner Williams stated these funds from the Department of Agriculture were requested for the promotion of the Walking Horse Association of Alabama on behalf of Mr. Jack Doss.
Commissioner Williams made the motion for the Chairman to sign the Memo of Understanding and Invoice. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Authorize Chairman to
negotiate and sign architectural agreement for D.H.R. Building
Gary Teichmiller, County Administrator stated the firm F& O architect has presented us with an architectural agreement which needs to be reviewed by the county commission and authorize the chairman to sign the agreement.
Commissioner Williams made the motion to authorize the chairman to sign the agreement after it’s reviewed by the county attorney. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Authorize Chairman to
sign one (1) year Cable Franchise extension agreement with Time Warner, Charter
Communications and Southern Cablevision
Mr. Teichmiller stated these are the three (3) cable companies that operate within the Cullman. These are nonexclusive agreements that we have been extending from year to year.
Commissioner Williams made the motion to allow the chairman to sign the agreements to extend them for one (1) more year. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Authorizing
contracting with Ritchie Bros. Auctioneers for the sell of Mack Trucks
Mr. Fred Penn, County Engineer state two (2) quotes were received for the sell of the Mack Trucks. Ritchie Bros Auctioneers quote was the highest with a quote of $727,300.00. There’s a $4,700.00 difference in the guaranteed sell price quoted by Ritchie Bros. and the purchase price. I recommend going with Ritchie Bros. Auctioneers.
Commissioner Willingham made the motion to except the bid from Ritchie Bros. Commissioner Williams seconded, and upon a voice vote, the motion passed unanimously.

Consider acceptance
of County Road 51 extension
Welcome new Probate
Judge
Commissioner Williams stated he would like to recognize the newly elected Probate Judge Leah Lust and welcome her to the County Commission Meeting.

Chairman Kitchens announced the next regular commission meeting will be Tuesday, February 13th at 10:00 am in the County Commission Office Conference Room
