COMMISSION MEETING
April 10, 2007
CALL TO ORDER AND WELCOME
A regular meeting of the Cullman County Commission was held Tuesday, April 10, 2007 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.
CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Doug Williams, Commissioner Wayne Willingham and Attorney Dan Willingham. Mr. Willingham gave the invocation and Chairman Kitchens lead the pledge of allegiance.
APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED
Commissioner Willingham made the motion to approve. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
PUBLIC COMMENTS
Janet Jean – Addressed the County Commission concerning County Road 234. Ms Jean stated her family owns property on this road and requesting the commission not to close this road.
Mr. Bob Cook – Addressed the County Commission concerning County Road 234. Mr. Cook stated his mother-in-law Mrs. Hogeland owns property on County Road 234 and she is opposed to closing this road.
NEW BUSINESS
Consider awarding Bid No. 889 – Sweeper (East)
Commissioner Williams stated only one (1) bid was received. I make the motion we accept the bid from Joe Money for on the East Side road sweepers.
Commissioner Willingham seconded, and upon a voice vote the motion carried unanimously.
Price $26,121.00 – 2006 model
Consider awarding Bid No. 890 – Sweeper (West)
County Engineer Fred Penn stated Joe Money was the only bidder for the sweeper at a cost of $26,650.00 for a 2006 model. The reason this sweeper if a little higher is because the sweeper for the East Side had approximately 200 Hrs. and this one is new.
Commissioner Willingham made the motion to accept the bid. Commissioner Williams seconded and upon a voice vote the motion carried unanimously.
Consider awarding Bid No. 891 – Reinforcing Steel
Mr. Penn stated two (2) bids were received. I recommend awarding to the low bidder Apel Machine & Supply Co. Inc.
Commissioner Williams made the motion to accept the bid from Apel Steel. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Consider awarding Bid No. 892 – Aggregate
Mr. Penn state three (3) bids were received. I recommend awarding all three vendors the bid.
Commissioner Willingham made the motion to award to all three vendors. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider the surplus of a 1998 Ford Crown Vic – Sheriff’s Department
Commissioner Williams made the motion to surplus the 1998 Ford Crown Vic. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Administration of NFIP – EMA
EMA Director Phyllis Little, stated this is concerning the National Flood Insurance Program, the administration part. In a letter dated March 4, 2007 to the County Commission. I respectfully requested that the administration part be transferred to the Engineering Department under the County Engineers supervision.
Commissioner Williams made the motion to transfer the administration part of the NFIP from the EMA Director to the County Engineer. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Board Appointment – Regional Housing Authority – Chairman
Chairman Kitchens made the motion to re-appoint Mrs. Linda Cabri to the Regional Housing Authority. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Resolution No. 2007-19 – Dress Code
Commissioner Willingham stated several issues concerning dressing on the job that needs to be addressed.
Attorney Willingham said primarily this is a safety and appearance issue with the road department. You have county employees out in the public that need to be wearing clothing and foot wear that is appropriate for the job. Anyone working for the county should wear proper clothing. I went in more detail for the road department. Mr. Willingham stated the Dress Code does not give specifics for other department, but each department can address this at anytime.
Chairman Kitchens stated every department head will need to deal with their employees on how they dress.
Commissioner Willingham made the motion to adopt the dress code. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider granting extension until March 26, 2008 for surety held by Cullman County Commission for Lake Alaqua Subdivision located in District 4 on County Road 479
County Engineer Fred Penn stated the county has granted an extension before on this subdivision. No lots have been sold, but the developer is fixing to start building him a house. Keith Creel, Subdivision Inspector stated this bond is for the paving only, the bonding company has approved the extension.
Commissioner Williams made the motion to approve the extension until March 26, 2008. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Consider preliminary plat for Cedar Ridge Subdivision located in District 2 off County Road 330
Mr. Penn stated Cedar Ridge Subdivision is located in the Sulfur Springs area. I recommend the preliminary plat be approved.
Commissioner Willingham made the motion to consider the preliminary plat. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider plat for Cedar Cove Subdivision located in District 2 off County Road 330
Mr. Penn stated Cedar Cove Subdivision is also located in the Sulfur Springs area. Mr. Penn said they have looked over the plat and recommend approval.
Commissioner Willingham made the motion to approve the plat for Cedar Cove Subdivision. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider design speed variance and preliminary plat for Watersound Subdivision located in District 3 off County Road 351
Mr. Penn stated they have looked at this and found several things that need to be addressed. I recommend tabling this until changes can be made.
Commissioner Willingham made the motion to table until a later time. Commissioner Williams seconded, and upon a voice vote, the motion carried.
Resolution No. 2007-20 Lower Speed Limit on County Road 1112
Mr. Penn stated this is the loop road at central that loops off County Road 1043 and comes back out onto County Road 1043. This road has a lot of sharp curves. I recommend a speed limit of 30 MPH.
Commissioner Willingham made the motion to post the road. Commissioner Williams seconded, and upon a voice vote, the motion past unanimously.
Memo of Understanding with the Department of Agriculture and Industries.
Commissioner Williams stated he had met with Agriculture Commissioner Sparks to replace the heating system at the Agriculture Center. This is the Memo of Understanding for $3500.00 to replace the heating system.
Commissioner Williams made the motion for the Chairman to sign the Memo of Understanding to receive the grant. Commissioner Willingham seconded, and upon a voice vote, the motion passed unanimously.
OLD BUSINESS
Pay Policy
Mr. Willingham, County Attorney said last time he had mentioned the pay policy and wanted department heads to have a chance to look over the policy. I am not sure all departments have seen it. I want to make sure all departments received the pay policy and have an opportunity to look over the policy and put it on the agenda for the next commission meeting.

Chairman Kitchens announced the next regular commission meeting would be Tuesday, April 24, 2007 at 10:00 am in the Commission Office Conference Room.
