COMMISSION MEETING
June 26, 2007
CALL TO ORDER AND WELCOME
A regular meeting of the Cullman County Commission was held Tuesday, June 26, 2007 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.
CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Doug Williams, Commissioner Wayne Willingham and Attorney Dan Willingham. Mr. Dan Willingham gave the invocation and Commissioner Williams lead the pledge of allegiance.
APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED
Commissioner Williams made the motion to approve. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
PUBLIC COMMENTS
Kenneth Kilgo , Director, Cullman Chapter of the American Red Cross addressed the commission concerning the functions of the American Red Cross, the new guidelines that are being handed down to each chapter and ask for the commission to consider an increase in the Red Cross budget for the next fiscal year.
Mrs. Sue O’Neal a resident on County Road 404 addressed the commission concerning the wood fence on County Road 404 that is still blocking the view on this road. Someone with the road department had spoken to the property owner about moving the fence, all that has been done is a few boards were removed. Also, was concerned about the speed since this road has been widened.
Mr. Marlon Maze from the New Canaan area thanked the commission for all the work in that area and the new community center the commission purchased. Mr. Maze also invited the commission to a meeting at the Joppa Fire Department this night at 6:30 pm. This meeting will be concerning the extra taxes and privilege taxes the City of Arab is charging.
NEW BUSINESS
Authorized Chairman to sign revised Housing Contract with Shelby County Regional Juvenile Detention Facility and Cullman County for one (1) year.
Commissioner Williams stated at this time Cullman County has an agreement with Shelby County to house long term juveniles for one year. I made a motion to authorize the Chairman to enter into the agreement to extend the contract for one year. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Construction Contracts for the Airport Improvement Projects – Bob Burns
Bob Burns with the Cullman Airport informed the Commission of the FAA grant for the airport that has been approved.
Authorize Chairman to negotiate and sign agreement with architect and engineering firm for ORV Park
Commissioner Williams made the motion to authorize the Chairman to enter into an agreement after the Commission selects an engineering firm. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Authorize Chairman to sign purchase agreement for the Fuller Property located at 2nd Ave. SW
Chairman Kitchens stated this is the remaining property just south of the courthouse. This will give the County the entire block.
Commissioner Williams made the motion to authorize the Chairman to sign the agreement to purchase the Fuller Property. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Resolution No. 2007-37 Authorize Chairman to apply for third grant for ORV Park
The 2008 grant is the third grant with ADECA for the third faze for purchasing ORV property. The grant is estimated at being $580,000.00
Commissioner Willingham made the motion to authorize the Chairman to apply for the grant. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Dorsey Creek Land Purchase
County Attorney Dan Willingham stated this is also in connection with the ORV Park. This property is approximately 2½ acres adjacent to it. After negations with Dorsey Creek owners the will sell the property and the small building for $5,000.00. They have an appraisal for $19,000.00. I recommend allowing the Chairman to sign for the purchase of this property.
Commissioner Willingham made the motion to allow the Chairman to sign for the purchase of the property. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider awarding Bid No. 888 Telecommunications
Commissioner Williams made the motion to award Bid No. 888 to Bell South Telecommunication. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Board Appointment Healthcare Authority – Chairman Kitchens
Chairman Kitchens appointed Mr. Allen Wood to the Healthcare Authority, due to the resignation of Mr. Eddie Burkart.
Commissioner Williams made the motion to accept the appointment to the Healthcare Authority. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Consider proposed plat for Bear Pen Subdivision located in District 2 off County Road 188
Keith Creel, Engineering Assistant stated Bear Pen Subdivision is in the Smith Lake area. We have received a preliminary plat everything is in compliance, I recommend approving the preliminary plat.
Commissioner Willingham made the motion to approve the preliminary plat. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider proposed plat for Four Waters Point Subdivision located in District 2 off County Road 203
Mr. Creel stated the proposed preliminary plat meets all State and County regulations. I recommend approving the plat. Commissioner Willingham made the motion to approve the preliminary plat. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Discuss Briarwood Estates Subdivision on County Road 1277 located in District 1
Mr. Willingham stated that National Mobile Home Deposal, Inc. has worked on the road and posted an assurety to get the completion of the road. They are having problems with the contractor and have ask that the assurety be forfeited over to the county for completion of the road. If any money is left over they will donate to the county. I recommend passing a resolution for taking in these funds.
Commissioner Willingham made the motion to adopt the resolution. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Resolution No. 2007-38 Consider change in fundamental classification in County Road 616 from minor to major collector road due to increase traffic flow
Fred Penn stated this is the Johnson Crossing Road that goes from Al Hwy. 31 West to Cullman boundary which is approximately 1.6 mile. A traffic count has been done on this road, with over 2000 vehicles per day this should not present a problem in the change.
Commissioner Williams made the motion to pass resolution no. 2007-30. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Authorize Chairman to sign agreement with NARCOG for Senior Community Service Employment Program Host Agency Agreement – AOA
Mr. Teichmiller stated this is a program thru NARCGO for Senior Citizens to work and are paid thru NARCGO. This is handled thru the Commission on Aging.
Commissioner Willingham made the motion to authorize the Chairman to sign the agreement with NARCOG. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Discuss Evaluations
Chairman Kitchens stated that the Commission is going to need to look at employee evaluations. The supervisors are marking evaluation all excellent and they will complain about the employee. When you look back they have given the employee all excellent marks.
Commissioner Williams stated the commission needs to sit down and look at the evaluation and set a firm policy. After getting a policy in place then speak with the department heads.

Chairman Kitchens announced the next regular commission meeting will be Tuesday, July 10, 2007 at 10:00 am in the County Commission Office Conference Room.
