COMMISSION MEETING
August 14, 2007

CALL TO ORDER AND WELCOME
A regular meeting of the Cullman County Commission was held Tuesday, August 14, 2007 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Doug Williams, Commissioner Wayne Willingham and Attorney Dan Willingham. Dan Willingham gave the invocation and Commissioner Williams lead the pledge of allegiance.

APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED
Commissioner Willingham made the motion to approve. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

PUBLIC COMMENTS

Mr. George Mann with the Purple Heart appealed to the commission for a donation to the Purple Heart to help with concrete work and a ramp.
Chairman Kitchens recommended the same donation that was given to the VFW.
Commissioner Williams made the motion to donate $500.00 to the Purple Heart. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

NEW BUSINESS

Consider Budget Revision Request – Reappraisal
Kay D. Smith, Revenue Commission explained this is some grant money going back into the budget. Any money taken in has to be accounted for thru the State.
Commissioner Williams made a motion to allow the Chairman to sign the form to account for the money. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

Consider the surplus of various computer equipment – Revenue
The Revenue Commissioner stated monitors had been upgraded and surplus the old monitors.
Commissioner Williams made the motion to surplus the monitors. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

Consider the surplus of one RICOH 5840 copier – Safety Dept.
The Safety Department stated this copier was transferred from Probate, its does not work and we would like to surplus this equipment.
Commissioner Willingham made the motion to surplus the copier. Commissioner
Williams seconded, and upon a voice vote, the motion carried unanimously.

Resolution No. 2007-48 Emergency Water Conservation Plan
David Bussman, Manager of the Cullman County Water Department stated the City of Cullman Water Department, Cullman County Water Department and all other water systems located in the county have readjusted the phases at which this conservation plan will go into effect and it all relates to how full Lake Catoma is. As a joint effort when there is a reduction in use it’s announced one time and it follows thru all the water systems that receive water from the City of Cullman. As of this morning Cullman has announced they are in phase one, requesting a voluntary 10% reduction in water used by customers. If the situation continues probable will be going to a mandatory reduction in three weeks. The only change in the Conservation Plan is how the phases are enacted.
Commissioner Williams made the motion to pass the Emergency Water Conservation Plan. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

Resolution No. 2007-49 CDBG Project No. CY-CM-PF-06-006
Mr. Bussman stated this project was bid in July of 2007 10-11 bids was received. The low bidder was C.D. Roberts Contracting, Inc. out of Jasper with a bid of $329,071.00. This is grant money with a county match of $40,000.00 and the rest coming from a Community Development Block Grant.
Commissioner Williams made the motion to allow the Chairman to sign and accept the grant. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

Consider 4-Way Stop at the intersection of County Road 222 and County 813
Commissioner Willingham made the motion to install a 4-way stop at the intersection of County Road 222 and County Road 813. Commissioner Williams seconded and upon a voice vote, the motion passed unanimously.

Consider vacation of 60 foot right of way located between Lot 17 and Lot 18 and amended survey of Lot 17 in Hidden Lake Subdivision located in District 4 on County Road 676
Mr. Willingham, County Attorney stated this is with in Hidden Lake Subdivision located on the east side. This road within the subdivision was platted but never built. Mr. Kile Smith is the developer, but you also need the signatures of the two joining property owners which are Greg Smith and Johnny Shipley. A public hearing needs to be set for the next commission meeting.

 

Sanitation Report – James Rollo
Mr. James Rollo, Manger of the County Sanitation Department announced that during the summer road side garbage pickup program a total of 68.37 miles on 40 different county roads with a total of 24,468 pounds of garbage. We will continue to pickup on roads on a smaller scale. Next year we hope to staff at least five additional workers.

Consider proposed plat for Blue Heron Subdivision located in District 2 on County Road 226
Keith Creel, Engineering Assistant stated Blue Heron Subdivision is classified as a minor subdivision, part of the lots face county road 226 and part face county road 109 with a total of eleven lots. I recommend approval of the proposed plat. Commissioner Willingham made the motion to approve the plat for Blue Heron Subdivision. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

Consider release of $25,000.00 surety for The Overlook at Simpson Creek and acceptance of County Road 144 extension located in District 2
Mr. Creel stated the county accepted the surety several months ago for The Overlook at Simpson Creek. The Developer has completed the paving, we have inspected the road, and it meets all the county’s requirements. I recommend the release of the $25,000.00 surety and acceptance of the extension of county road 144.
Commissioner Willingham made the motion to release the surety and accept the extension. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

Resolution No. 2007-50 Reduce speed limit on County Road 412 to 15 MPH
Fred Penn, County Engineer stated this is a gravel road located close to the West Side Road Department that goes from county road 222 over to county road 438. This is a narrow gravel road with two houses located on this road. I recommend the speed limit be dropped to 15 MPH.
Commissioner Willingham made the motion to lower the speed limit to 15 MPH. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

Resolution No. 2007-51 – Project No. CCP-22-61-07 Traffic striping on various county roads: 747, 1223, 1114 and 565
Mr. Penn stated this is funding that came available from the Highway Administration. There’s $30,000.00 set aside for safety projects. We have actually have $60,000.00 this year to stripe various county roads. There is a 10% match from the county.
Commissioner Williams made the motion to accept the funding with a 10% match. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

OLD BUSINESS
Mr. Willingham stated there is a matter concerning the Library Board. The Director John Paul Myrick has resigned and an interim director needs to be appointed. I recommend allowing the Library Board to appoint the interim director.
Commissioner Williams made the motion to allow the Library Board to point the interim director. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

NEXT REGULAR COMMISSION MEETING TUESDAY, AUGUST 28, 2007
Chairman Kitchens announced the next regular scheduled Commission Meeting will be Tuesday, August 29, 2007 at 10:00 a.m. in the Commission Office Conference Room.
