COMMISSION MEETING
September 11, 2007
CALL TO ORDER AND WELCOME
A regular meeting of the Cullman County Commission was held Tuesday, September 11, 2007 at 10:00 a.m., in the County Commission Office Conference Room, Chairman Kitchens called the meeting to order and welcomed all visitors.
CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Doug Williams, Commissioner Wayne Willingham and Attorney Dan Willingham. Dan Willingham gave the invocation and Commissioner Williams lead the pledge of allegiance.
APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED
Commissioner Willingham made the motion to approve. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
PROCLAMATION
National Assisted Living Week
Beverly Denson with Victorian Manor presented to the Commission a Proclamation recognizing September 9 – September 15, 2007 as National Assisted Living Week.
PUBLIC COMMENTS
Kelly Allen announced that the month of September is “Be Prepared” across the nation which was done on the Homeland Security Level. EMA long with some of the first responders will be hosting a “Be Ready Day” Saturday, September 29, 2007, at the Fair Grounds. It will be open to the public from 9:00 am to 1:00 pm. First responders along with Local Fire Departments, Sheriff’s Department and along with regional equipment that your tax dollars has been spent on will be on display. Also on Tuesday night a weather spotter’s class will be held at 6:30 pm at the CCOB building.
George Mann presented Commissioner Williams with a plaque for his donations to the Purple Heart.
Linda Schaffner with Master Gardner’s of Cullman County stated the Master Gardner’s would like to put in a demonstration garden at the Hayes House that is owned by the Historical Society. The only problem is that the garden takes a lot of time and money to install. We would like to know if we could obtain a lease on this property or if this will be a semi-permanent location.
NEW BUSINESS
Consider establishing a 3-way stop at the intersection of County Road 1343 and County Road 1354
Fred Penn, County Engineer stated this intersection is located in the Vinemont area after inspecting this intersection we recommend installing a 3-way stop.
Commissioner Williams made the motion to install the 3-way stop at the intersection of County Road 1343 and County Road 1354. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Resolution No. 2007-51 Reduce speed on County Road 1685 to 25 mph
Commissioner Williams made the motion to reduce the speed on County Road 1685 to 25 mph. Commissioner Willingham seconded, and upon a voice vote, the motion passed unanimously.
Consider plat for Goodwin-Mills, Phase A Subdivision, located in District 2 on County Road 295
Keith Creel, Engineering Assistant stated county road 295 is a public road but has never been accepted into the county maintenance system. County Road 295 will have to be widened and repaved to meet county specifications. The county has been given a bond in the amount of $240,000.00 to cover the cost of paving this road to county specifications. I recommend approval of the final plat contingent upon the $240,000.00 bond and signatures on the plat.
Commissioner Willingham made a motion to accept plat of Phase A Subdivision contingent upon bond and signature. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Resolution No. 2007-53 Authorize Chairman to sign along with the Northeast Morgan Water Authority a Withdrawal Permit with the Tenn. River Authority
David Bussman, Manger of the Cullman County Water Department stated last year (2006) the Morgan County delegation successfully passed a bill thru the State Legislation that would allow water systems with a foot print in Morgan County to with draw water out of the Tennessee River.
Commissioner Williams made the motion to allow the Chairman to sign the withdrawal permit. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Authorize Chairman to sign Long Term Detention Subsidy Contract for FY 2008 with the Alabama Department of Youth Services
Mr. Teichmiller, County Administrator stated this is an annual contract between the County Commission and the Alabama Department of Youth Services. This agreement will provide Cullman County one (1) detention bed for the use of the juvenile court of Cullman for one (1) year.
Commissioner Willingham made the motion to authorize the Chairman to sign the contract. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Authorize Chairman to sign Contract with US Able Life
Mr. Teichmiller stated this is life insurance for Employees County wide. This will be and increase in life insurance from $10,000.00 to $15,000.00 with an option to increase spouse coverage from $5,000.00 to $7,500.00.
Commissioner Williams made the motion to authorize the Chairman to sign the Contract with US Able Life. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Authorize Chairman to sign Contract with BCS
Mr. Teichmiler stated this is the re-insurance on employee’s health benefits for Excess Loss Insurance in connection with its self-funded Employee Benefit Plan. If a claim goes over $75,000.00 BCS will pick up and pay.
Commissioner Williams made a motion to authorize the Chairman to sign the contract. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
S.L.I.S.A. – Jared Key
Mr. Key with the Smith Lake Improvement Stakeholder Association stated that their association is trying to resolve issues with Alabama Power to raise Smith Lake to have a fluctuation that will give year round access to the water. We have already presented this to Winston County Commission, what we are asking for is an economic impact study to done. The economy is affected when the lake levels go down to where you can’t use the water like it has done this year. Smith Lake is down almost seventeen feet now, the drought is not what makes the water leave the lake, and the drought is what makes the water not come back into the lake. I would like the county to be aware of how much money is loss because of the lake levels and contact the Winston County Commission and work in conjunction on an economic impact study.
Consider awarding Bid No. 907 – Networking Equipment
Joey Martian, IT Department Director stated only one (1) bid was received from Pomeroy IT Solutions. Pomeroy also has the State Bid and can give us a better price. I recommend rejecting this bid and going with the State Bid.
Commissioner Williams made the motion to reject Bid No. 907 and buy off the State Bid. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Consider awarding Bid No. 908- One (1) or more tractor(s)
Mr. Jody Camp, Park and Rec. Manager, stated two (2) bids were received. I recommend rejecting the bids and re-bid.
Commissioner Williams made the motion to reject the bids and re-bid. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
E-911 Board appointment – Chairman Kitchens
Chairman Kitchens made the motion to re-appoint Gordon Sandlin to the E-911 Board. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Parker Addition to Lakeview North Subdivision
Mr. Creel, stated the commission approved the preliminary plat in March of 2007. A bond in the amount of $7500.00 was made for paving. I recommend approval of the Parker Addition to Lakeview North Subdivision contingent upon the bond being issued in correct name and plat being signed by agencies.
Commissioner Williams made the motion to accept the Parker Addition to Lakeview North Subdivision contingent upon Engineers requirements. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
OLD BUSINESS
NEXT REGULAR COMMISSION MEETING MONDAY, SEPTEMBER 24, 2007
Chairman Kitchens announced the next regular commission meeting will be Monday, September 24, 2007.
Revenue Commissioner Kay D. Smith questioned the commission concerning the posting for the County Commission Office.
