COMMISSION MEETING
April 8, 2008

 

CALL TO ORDER AND WELCOME
A regular meeting of the Cullman County Commission was held Tuesday, April 8, 2008 at 10:00 a.m., in the County Commission Office Conference Room.  Chairman Kitchens called the meeting to order and welcomed all visitors.

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Wayne Willingham, Commissioner Doug Williams and County Attorney Dan Willingham. Attorney Dan Willingham gave the invocation and Chairman Kitchens lead the Pledge of Allegiance.

APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED
Commissioner Willingham made the motion to approve. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

PUBLIC COMMENTS

Dot Gudger addressed the Commission concerning the Hayes house located at 601 1st Ave SW. Mrs. Gudger stated the house was structural sound and the original light fixtures have been obtained to go back into the house. The master gardeners will be doing landscaping around the residence. The Historical Society is in the process of putting the Hayes House on the Register of Historical Places. Although the house is not ready to be moved, the Historical Society is requesting the $5,000.00 that has been promised from the Commission, with the understanding that at the time the house is moved the Society will already have received all monies promised by the Commission.
 
Mike Grizzard stated he owns some property at Greentree Estates located on County Road 630. He states a lady has built a house in what should be the county road and has blocked access to his property.   Mr. Grizzard has spoken with Commissioner Williams who stated this was not a county property. Mr. Grizzard stated the house is actually built on his property and the woman tries to have him put in jail every time he goes out there.   He has five lots for sell and is unable to proceed with any sales.  He wants to have this on record and see if something can be done with this issue.

County Attorney Dan Willingham stated this is something that goes back in time when you have a dedicated road and, in that sense, it is a public road. From what he understands this could be a public road but not a county maintained road.  That being the case, the county is somewhat involved.  Commissioner Williams asked Mr. Willingham to check into this further.

PROCLAMATION
Wallace State Community College – Chairman Kitchens read aloud the Proclamation Proclaiming the month of April 2008 as Wallace State Community College Month.

NEW BUSINESS

Consider awarding Bid No. 950 – Metal Pipe
County Engineer Fred Penn stated only one bid was received and recommended awarding the bid to Bear Concrete.  Commissioner Williams made the motion to award Bid No. 950 to Bear Concrete Pipe. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

Consider awarding the contract for OHV Park
Commissioner Williams said it was his understanding that the contract was to be awarded in three (3) phases; archaeological, environmental and wetlands.
Todd Hardman with St. John and Associates stated that the archaeological study is required to receive part of the funds and also the wetland delineation must be completed before construction can begin.
Chairman Kitchens said that once these two phases are completed, the county could start building trails.
Mr. Hardman said once theses environmental have been cleared, then the County will be cleared to begin work.  The estimated time should be around 30-45 days from the time the studies begin.
Commissioner Williams made the motion to award contract to St. John and Associates. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
 
Authorize EMA to accept Hazard Mitigation Grant - $13,000.00
EMA Director Phyllis Little stated that in May of 2007 the Commission authorized her to work with Lee Helms and Associates out of Clanton to apply for Federal Funding to update the Hazard Mitigation Plan. This grant was approved and paperwork was received last week. Cullman County was approved for $13,000.00 in grant money the federal share is $9,750.00 and the county will be responsible for the additional $3,200.00 which can be in-kind. Ms. Little asked for approval from the Commission to sign the grant and to contact Lee Helms and Associates to get the process started.
Commissioner Williams made the motion to go ahead and start. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

 

Resolution No. 2008-15 – Reduced Speed Limit on Day Gap Road
County Engineer Fred Penn said this is the road coming out of the Town of Good Hope over to Grandview where it runs into County Road 222. He requested the speed limit on the county’s portion of this road be reduced to 35 mph; the portion of this road located in the Town of Good Hope is already posted at 35 mph. The horizontal curves are the reason for the request to reduce the speed.  Commissioner Willingham made the motion to reduce the speed to 35 mph on Day Gap Road. Commission Willingham seconded, and upon a voice vote, the motion carried unanimously.

Consider proposed plat for Rocky Springs Subdivision located in District 3 off County Road 67
Engineering Assistant Keith Creel said this is a proposed subdivision in the Cold Springs area. The developer submitted a new plat that meets all the required regulations. Approval of the plat is recommended.   Commissioner Willingham made the motion to approve the proposed plat. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

Resolution No. 2008-16 – Nucor
Wes Sandifer with Nucor stated this is a resolution supporting Nucor’s efforts. There will be a Town Hall meeting on the 10th of April to discuss several issues like manufacturing job losses and trade issues.  Again, this is just a resolution supporting Nucor’s efforts.   Commissioner Williams made the motion to sign the resolution. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

Resolution No. 2008-17 National County Government Week
Chairman Kitchens proposed the resolution to the Commission. Commissioner Williams read aloud the resolution.  Commissioner Williams made the motion to allow the Chairman to sign the resolution. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.

OLD BUSINESS

Library Board Appointment
Commissioner Willingham made the motion to appoint Trina Walker to the Library Board. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.

NEXT REGULAR COMMISSION MEETING TUESDAY APRIL 22, 2008
Chairman Kitchens announced the next regular Commission Meeting will be Tuesday, April 22, 2008 at 10:00 am in the Commission Office Conference Room.
