COMMISSION MEETING
June 23, 2008
CALL TO ORDER AND WELCOME
A regular meeting of the Cullman County Commission was held Monday June 23, 2008 at 10:00 a.m., in the County Commission Office Conference Room. Chairman Kitchens called the meeting to order and welcomed all visitors.
CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Present were Chairman Wiley Kitchens, Commissioner Wayne Willingham, Commissioner Doug Williams and County Attorney Dan Willingham. Attorney Dan Willingham gave the invocation and Commissioner Williams lead the Pledge of Allegiance.
APPROVE MINUTES, APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSE AND ALL JOURNAL ENTRIES TO BE POSTED
Commissioner Willingham made the motion to approve. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
PUBLIC COMMENTS
A resident from the west side of the county thanked the Commission for work done in their area.
NEW BUSINESS
Resolution No. 2008-30 Set speed on County Road 1094 at 25 mph
Mr. Fred Penn, County Engineer, said this is a dead end road in the Bethel area (Glovers Plant Farm Road) and suggested the speed limit be lowered to 25 mph. Commissioner Willingham made the motion to lower the speed on county road 1094 to 25 mph. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider acceptance of County Road 184 extension located in District 2
Mr. Keith Creel, Engineering Assistant, stated this is a road that has been worked on during the last three years. The road has been widened, aggregate base put down, and asphalt applied. The Engineering Department has inspected the road at different intervals, right of way documents have been obtained and, at this time, request that the Commission accept this extension into the county’s maintenance system. Commissioner Willingham made the motion to accept county road 184 extension into the county maintenance system. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Consider acceptance of the proposed plat for Shadowrock Subdivision located in District 2
Mr. Creel stated this is a preliminary plat for a new subdivision. This subdivision meets all the requirements and the recommendation is for the Commission to accept the preliminary plat. Commissioner Willingham made the motion to accept the preliminary plat. Commissioner Williams seconded and upon a voice vote, the motion carried unanimously.
Consider granting an extension for surety held by the Cullman County Commission for Bear Pen Creek Subdivision in District 2 off County Road 188
Mr. Creel stated the surety posted for Bear Pen Creek Subdivision will expire this month and the developer requests a surety extension until September of 2008. Commissioner Willingham made the motion to grant an extension for the surety until September 2008. Commissioner Williams seconded, and upon a voice vote, the motion carried unanimously.
Bid No. 959 One or more Dozer(s)
Commissioner Williams made the motion to reject all bids due to modifications which need to be made in the bid specifications and rebid after the modifications are made. Commissioner Willingham seconded, and upon a voice vote, the motion carried unanimously.
Consider revising the County Drug and Alcohol Abuse Policy
Mr. Willingham said he has drafted the changes to the policy and discussed some of the changes. One of the proposed changes strengthens the policy the county already has. The revised policy states that in the event of any accident or injury, the employee is automatically required to be tested for drug or alcohol use. A section has also been added to allow the employee, if there is a positive result to the test or if the employee admits to having a problem, to seek rehabilitation at their own expense. The county will not pay for those costs. There was additional discussion regarding the proposed changes and it was generally agreed that the changes need to be more specific. Commissioner Williams made the motion to table this item until some changes can be made to the policy.
Consider acceptance of County Road 218 extension located in District 2
Assistant Engineer Keith Creel stated this road has been widened and paved and the developers have guaranteed maintenance of the road for one year. The road ends in a cul-de-sac and has been inspected at different intervals. Mr. Creel recommended acceptance of the extension of County Road 218 into the county maintenance system. Commissioner Willingham made the motion to accept the extension of County Road 218. Commissioner Williams made a second to the motion and, upon a voice vote, the motion passed unanimously.

NEXT REGULAR COMMISSION MEETING WEDNESDAY, 9, 2008
Chairman Kitchens announced the next regular Commission meeting will be Wednesday, July 9, 2008. The change in the Commission Meeting date is due to an Associate Commissioner being unable to attend.

Commissioner Williams made the motion to adjourn. Commissioner Willingham seconded.
