CALL TO ORDER AND WELCOME
Chairman James Graves called the Commission Meeting to order at 9:55 a.m. and welcomed the visitors.
CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Charlotte Slatton, County Clerk, called the roll; present were Chairman James Graves, Commissioner Wayne Willingham, Commissioner Doug Williams and County Attorney Dan Willingham. The invocation was given by Dan Willingham and Commissioner Doug Williams led the Pledge of Allegiance
APPROVE MINUTES OF THE DECEMBER 8, 2009 MINUTES, APPROVE APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSES; AND APPROVE ALL JOURNAL ENTRIES TO BE POSTED.
Commissioner Wayne Willingham made the motion to approve the December 8, 2009 minutes, approve appropriations, expenditures, requisitions, travel expenses and approve all journal entries to be posted. Commissioner Doug Williams made a second to the motion, and upon a voice vote, the motion carried unanimously.

NEW BUSINESS
Public Hearing – Resolution 2010-13 - Vacating of County Road 1073
Public Hearing – Resolution 2010-14 – Vacating of County Road 1074
Commissioner Willingham stated County Road 1073 and 1074 are adjoining roads which have been requested to be vacated; however opposition has been expressed by local residents and land owners in addition to the VAW Water System which has waterlines along the road. He made a motion not to vacate County Road 1073 and 1074. Commissioner Williams seconded. The motion passed on a unanimous voice vote.
Public Hearing – Resolution 2010-15 – Vacating a portion County Road 630
Dan Willingham, County Attorney, read aloud the description of the unconstructed portion of County Road 630 that is to be vacated. He stated the right-of-way will be divided in the center with each property owner receiving property. Ginger Taylor, a resident of County Road 630, asked for clarification of the vacating of the road and was assured that only the unconstructed portion was being vacated, not the paved roadway. Commissioner Williams made a motion to close the public hearing. Commissioner Willingham seconded. Commissioner Willingham made a motion to vacate the unconstructed portion of County Road 630 as described in the reading. Commissioner Williams seconded, and upon a voice vote, the motion passed.
Public Hearing – Resolution 2010-16 – Vacating a portion of County Road 304
Commissioner Willingham stated County Road 304, which is off County Road 813, virtually does not exist due to overgrowth. There were no opposing comments. Commissioner Willingham made a motion to close the public hearing. Commissioner Williams seconded. Commissioner Willingham made a motion to vacate County Road 304. Commissioner Williams seconded. The motion carried on a unanimous voice vote.
Public Hearing – Resolution 2010-17 – Vacating of County Road 1650
Public Hearing – Resolution 2010-18 Vacating Stidham Road
Attorney Willingham stated all property owners have requested the vacating of County Road 1650 and Stidham Road which join. He stated Stidham Road does not exist due to overgrowth. David Bussman, Water Department Manager, stated the County Water Department has a 10” waterline along County Road 1650 with a fire hydrant at the intersection of Highway 278 and requested a utility easement be maintained. Commissioner Williams made a motion to close the public hearing. Commissioner Willingham seconded. Commissioner Williams made a motion to vacate County Road 1650 and Stidham Road contingent on a utility easement being maintained on County Road 1650. Commissioner Willingham seconded. The motion passed on a unanimous voice vote.
Public Hearing – Resolution 2012-19 – Vacating a portion of County Road 1770
Attorney Willingham read aloud the description of the portion of County Road 1770 to be vacated. Commissioner Williams stated signatures have been received from all property owners. Commissioner Williams made a motion to close the public hearing. Commissioner Willingham seconded. Commissioner Willingham made a motion to close a portion of County Road 1770 as described in the resolution. Commissioner Williams seconded, and upon a voice vote, the motion carried.
Authorize the Chairman to sign documents for liability insurance
Gary Teichmiller, County Administrator, stated this is the second year of a three year agreement with the ACCA. The premiums are $441,421.00 which represents a 1% increase. He recommended approval. Commissioner Williams made a motion to authorize the Chairman to sign the documents for the liability insurance. Commission Willingham seconded. Upon a unanimous voice vote, the motion passed.
Consider a donation of $1,000.00 to the Baileyton Senior Center
Commissioner Williams stated the Baileyton Senior Center is in need of some immediate repair and made a motion to donate $1,000.00 to the Center. Commissioner Willingham seconded, and upon a voice vote, the motion passed.
Authorize the Chairman to sign an agreement with St. John & Associates for EPA monitoring data on the closed Cullman County Sanitary Landfill
Chairman Graves stated some minor problem has occurred at the closed landfill which requires additional monitoring data at a cost of $1,850.00. Commissioner Willingham made a motion to authorize the Chairman to sign the agreement with St. John & Associates for the monitoring data. Commissioner Williams seconded with the motion passing on a unanimous voice vote.
Authorize the Chairman to sign contracts with Johnson Crossing Water and Walter Water Authority for the purchase of water from the Cullman County Water Department
Commissioner Willingham made a motion to authorize the Chairman to sign contracts with Johnson Crossing Water and Walter Water Authority for the purchase of water from the Cullman County Water Department. Commissioner Williams seconded, and upon a unanimous voice vote, the motion passed.
Consider plat for Ridgeway’s Addition To Cullman located in District 1 on Al Hwy 157
Keith Creel, Assistant Engineer, stated the subdivision is located west of I-65 on Highway 157. It consists of three lots of two and one half (2.5) acres each. It meets the County’s requirements for a minor subdivision. The City of Cullman has been notified as this falls within the City’s extra territorial planning. One signature box requires correction. He recommended acceptance contingent on the correction. Commissioner Willingham made a motion to accept the plat for Ridgeway’s Addition To Cullman contingent on the necessary corrections. Commissioner Williams seconded. The motion passed on a unanimous voice vote.
Consider awarding Bid No. 1029 – Computer Equipment
Joey Martin, IT Director, recommended awarding the bid to IS Corp with the overall low bid. Commissioner Williams made a motion to award the bid for computer equipment to IS Corp. Commissioner Willingham seconded, and upon a unanimous voice vote, the motion passed.
Beginning January 1, 2010 reimbursement for mileage will be $.50 per mile
The states new reimbursement rate will be $.50 per mile effective January 1, 2010. Commissioner Williams made a motion to adopt the state’s reimbursement rate of $.50 per mile. Commissioner Willingham seconded. The motion passed on a unanimous voice vote
Chairman Graves announced there will be a public meeting held January 4, 2010 at 6:30 p.m. in the 3rd floor courtroom concerning pending permit applications for strip mining in Cullman County.
Chairman Graves announced the next meeting of NARCOG will be January 27, 2010 at the Decatur office of NARCOG.

Chairman Graves announced the next regular Commission Meeting will be Tuesday, January 12, 2010, at 10:00 a.m. in the Commission Office Conference Room.

Chairman Graves asked if there was further business to consider and there was none. Chairman Graves adjourned the meeting at 10:32a.m.
