CULLMAN COUNTY COMMISSION MEETING
April 12, 2010

CALL TO ORDER AND WELCOME

Chairman James Graves called the Commission Meeting to order at 10:05 a.m. and welcomed the visitors.

CALL OF ROLL TO ESTABLISH QUORUM, INVOCATION AND PLEDGE OF ALLEGIANCE
Charlotte Slatton, County Clerk, called the roll; present were Chairman James Graves, Commissioner Doug Williams, Commissioner Wayne Willingham, and County Attorney Dan Willingham.  The invocation was given by Dan Willingham and Commissioner Wayne Willingham led the Pledge of Allegiance.

APPROVE MINUTES OF THE MARCH 23, 2010 MINUTES, APPROVE APPROPRIATIONS, EXPENDITURES, REQUISITIONS, TRAVEL EXPENSES; AND APPROVE ALL JOURNAL ENTRIES TO BE POSTED.
Commissioner Willingham made the motion to approve the March 23, 2010 minutes, approve appropriations, expenditures, requisitions, travel expenses and approve all journal entries to be posted.  Commissioner Williams seconded the motion, and upon a voice vote, the motion carried unanimously.

PUBLIC COMMENTS
Ron Stone apologized to the Chairman for failing to extend an invitation to the meeting that was held concerning Duck River and agricultural concerns.  He stated the meeting was one sided since he opposes the Duck River project.  He expressed concerns over the possibility of County Road 1651 being closed and presented a letter from the fire chief of Berlin which expressed his concern on their response time.   Mr. Stone stated he is considering a class action suit if there are 40 plaintiffs and wants the County to pay for the attorney.

Shirley Rhodes, a resident of County Road 222, addressed the Commission concerning an ongoing drainage problem.  She stated she came before the Commission last year and nothing has been done to fix the problem.  Commissioner Willingham stated the county engineer has looked at the area in question and the problem stems from the County’s 24” pipe carrying water to an area where a 15” pipe is installed on private property.  The 15” pipe is unable to drain the water and it backs up on Ms. Rhodes’ property.  Commissioner Willingham asked Mr. Penn, the County Engineer, to see if there is something the County can do to fix the drainage.

NEW BUSINESS
 Consider copier lease agreement for Revenue Department
Tammy Brown, Chief Clerk from Revenue, stated the copier lease agreement is with Bryan Business Solutions.  Commissioner Williams made a motion to approve the copier lease agreement for the Revenue Department.  Commissioner Willingham seconded, and upon a unanimous voice vote, the motion passed.

 Consider surplus of computer, monitor and scanner from Sales Tax
The Sales Tax Office requested a Bell & Howell scanner, serial # 98293B765, and an obsolete computer and monitor be declared surplus.  Commissioner Williams made a motion to surplus the equipment.  Commissioner Willingham seconded.  The motion passed on a unanimous voice vote.

 Consider surplus of one (1) 1999 Ford Crown Vic from Sheriff’s Department
Deputy Rob Cook, Fleet Manager for the Sheriff’s Department, requested a 1999 Ford Crown Vic, VIN # 2FAFP71W1XX123788, be declared surplus due to extreme mileage.  Commissioner Williams made a motion to surplus the patrol car.  Commissioner Willingham seconded, and the motion carried on a unanimous voice vote.

Consider approval of leadership training seminar sponsored by Revenue Department
Tammy Brown from the Revenue Department stated the training is a two (2) day program with four (4) hour sessions with approximately 10 people per session.  All County Departments will be asked to participate.  Commissioner Willingham made a motion to approve the leadership training seminar to be sponsored by the Revenue Department.  Commission Williams seconded.  The motion passed on a unanimous voice vote.
           
Approval of the revised CARTS drug policy
Chairman Graves stated the drug policy is mandated by the Federal Transit Authority in order for CARTS to continue to receive federal funding.  The CARTS policy is different from the County’s drug policy.  Commissioner Willingham made a motion to approve the revised CARTS drug policy.  Commissioner Williams seconded and the motion carried on a unanimous voice vote.

Approval of the issuance of $7,255,000 Taxable Water Revenue Warrants
Chairman Graves stated the bond issue for the Water Department is for infrastructure which will be mainly on the west side of the County.  All commissioners were in agreement the improvements were needed.  Commissioner Williams made a motion to approve the issuance of $7,255,000 in taxable water revenue warrants.  Commissioner Willingham seconded the motion which passed on a unanimous voice vote.

Resolution 2010-29 – Set speed limit on County Road 631 at 15 MPH
Fred Penn, County Engineer, stated the road is in the Hopewell Church area.  It is a curved road in a residential area and he recommended setting the speed limit at 15 MPH.  Commissioner Williams made a motion to set the speed limit on County Road 631 at 15 MPH.  Commissioner Willingham seconded.  The motion carried on a unanimous voice vote.

Bid No. 1037 – Elevator Service
Gary Teichmiller, County Administrator, recommended awarding the bid to Otis Elevator Co., the low bidder at $800.00 per month.  Commissioner Williams made a motion to award the bid.  Commissioner Willingham seconded and the motion passed on a unanimous voice vote.

 Bid No. 1038 - SMORT-1 Protective Clothing and Footwear
Phyllis Little, EMA Director, stated this is a 100% grant which will be used to replace clothing and footwear.  Commissioner Williams made a motion to award the bid to NEFECO, Inc. for SMORT-1 protective clothing and footwear.  Commissioner Willingham seconded, and upon a unanimous voice vote, the motion passed.

Bid No. 1039 – Gasoline & Diesel Fuel
Mr. Penn stated there were several bids.  RKA Petroleum Co. from Michigan was the low bidder. Edison Petroleum, Inc., who currently has the bid, was slightly higher but within the 3% margin for local bids.  He stated Edison has provided good service and since they are within the 3% margin, he recommended awarding the bid to them.  Commissioner Willingham made a motion to award the bid for gasoline and diesel fuel to Edison Petroleum, Inc.  Commissioner Williams seconded.  With a unanimous voice vote, the motion passed.

Bid No. 1040 – Off Road Fuel
Mr. Penn recommended awarding the bid to the current supplier, Edison Petroleum, Inc., who was the low bidder.  Commissioner Williams made a motion to award the bid for off road fuel to Edison Petroleum Inc.  Commissioner Willingham seconded, and upon a unanimous voice vote, the motion carried.

Bid No. 1041 – Batteries
Mr. Penn recommended awarding the bid to NAPA Auto Parts who submitted the overall low bid.  Commissioner Willingham made a motion to award the bid for batteries to NAPA Auto Parts.  Commissioner Williams seconded.  The motion carried on a unanimous voice vote.
           
Bid No. 1042 – Traffic Signs
The County Engineer stated the low bidder was IBIS Signs; however in review of the bid from IBIS Signs some items were not bid which resulted in the lower overall bid.  He recommended awarding the bid to Traffic Signs, Inc. who currently has the bid.  Commissioner Willingham made a motion to award the bid for traffic signs to Traffic Signs, Inc.  Commissioner Williams seconded, and upon a unanimous voice vote, the motion passed.

Bid No. 1043 – Placement of Bituminous Plant Mix
There was one bidder, Charles E. Watts, Inc.  The price was slightly lower than last year’s price.  Commissioner Williams made a motion to award the bid for placement of bituminous plant mix.  Commissioner Willingham seconded.  The motion carried on a unanimous voice vote.

Bid No. 1044 Bulk Cement
Mr. Penn stated the low bidder was Lehigh Cement Company and recommended awarding the bid.  Commissioner Willingham made a motion to award the bid for bulk cement to Lehigh Cement Company.  With Commissioner Williams’ second, the motion passed on a unanimous voice vote.

 Bid No. 1045 – Emulsified Asphalt AE-P
Commissioner Williams made a motion to award the bid for emulsified asphalt AE-P to the low bidder, Vulcan Asphalt.  Commissioner Willingham seconded.  The motion passed on a unanimous voice vote.

 Bid No. 1046 – Concrete
Mr. Penn stated DCA Ready Mix was the low bidder and recommended awarding the bid.  Commissioner Willingham made a motion to award the bid for concrete to DCA Ready Mix.  Commissioner Williams seconded, and upon a unanimous voice vote, the motion carried.

 Bid No. 1047 – Guardrail
The County Engineer recommended awarding the bid to Alabama Guardrail, the only bidder.  Commissioner Williams made a motion to award the guardrail bid to Alabama Guardrail.  Commissioner Willingham seconded and the motion passed on a unanimous voice vote.
Bid No. 1048 – Concrete Pipe
Mr. Penn stated Vellano Brothers from Lincoln, AL was the low bidder.  They are a new bidder, but he recommended awarding the bid and evaluating their job performance.  Commissioner Williams made a motion to award the concrete pipe bid to Vellano Brothers.  Commissioner Willingham seconded, and upon a unanimous voice vote, the motion passed.

Bid No. 1049 – Jail Supplies
Eulaylon Hadley from the Sheriff’s Department recommended awarding the bid to Paper & Chemical Supply the low bidder who currently has the bid.  Commissioner Williams made the motion to award the bid for jail supplies to Paper & Chemical Supply. Commissioner Willingham seconded the motion which passed on a unanimous voice vote.

Inform the public of PALS County/City Clean-up Saturday, April 24 from 8:00-12:00
Chairman Grave announced PALS is sponsoring the annual clean-up on April 24.  There will be manned dumpsters located throughout Cullman County and bags will be furnished so citizen can help clean up roads around their homes.

Gary Teichmiller, County Administrator, reported sales tax receipts were up in February, as compared to February 2009, by approximately 3%.

Chairman Graves stated Sunday’s Birmingham News reported the Federal Energy Regulatory Commission (FERC) relicensed Smith Lake Dam; however some restrictions requested by area residents were denied.  The FERC is requiring Alabama Power to improve areas around the lake to include adding a new fishing pier at Smith Lake Park.

Chairman Graves announced the next meeting of NARCOG will be April 28, 2010 at the Decatur office of NARCOG.  Commissioner Willingham stated Neal Morrison, NARCOG Director, will have a six month evaluation by the personnel committee on April 15.

NEXT REGULAR COMMISSION MEETING MONDAY APRIL 27, 2010
Chairman Graves announced the next regular Commission Meeting will be Tuesday, April 27, 2010 at 10:00 a.m. in the Commission Office Conference Room.

Commissioner Williams made a motion to adjourn the meeting.  Commissioner Williams seconded.  Chairman Graves adjourned the meeting at 10:36 a.m.
